Both of my wifes parrents are gone.. it is pure hell with out a will.. Even with a will if there was a prior version, the new will can be argued.. I feel for the daughter. Scott, let us know if something starts going..
Ryan, normally if it goes into a trust, she may have access to it through whomever the guardian turn out to be.

Sheldon, it is a bunch of things over here for the water, one, busted line, two Lots of snow and rain lately, 3 The house is on clay.. So there is no place for the water to go, even after it is pumped out of the house, it just leaches back in..THe boys had a riot. They were both very excited about helping me.. and they Really did Help, we had sword fights, wrestling and ect, it was guys night out.
I hate to hear of these different struggles that some of you guys are going through, and will pray for the various needs in each situation.
Regarding the will and your need to update it... that can be a very serious issue indeed. My wife and I are guilty of desperately needing to update ours again, and have been for several years. Point is this, when you have young children and set up your will, identifying legal guardians to take your children should something happen to both of you, make sure to keep abreast of whether or not the chosen guardian would STILL be your chosen guardian on a regular basis. That is the part we are struggling the most with right now because we need to change that designation and are at a loss of who to change it to... seems there is no "best" situation.
Not to get anyone down but I feel that I need to get this message out.
As y'all know, I had a close friend (and coworker) pass away unexcpectedly over the weekend. He had a heart attack during the night and passed away in his sleep. He was a single father and his 13 year old daughter found him dead in bed when she went in to wake him up.
He had the usual plans that we all have, life insurance, 401k, pension, etc. For all of these his daughter is the beneficiary.
You would think that everything is ok in regards to money.
Not so. Because she is a minor, all of the money is automatically going into a trust fund. To use the money, the court must approvce and dispense the money. Usually, this isn't a problem but in this case, it is.
There is no money to bury my friend. He has no surviving family to help. Because of this, I have become painstakingly aware of just how expensive it is to die. The funeral costs (and this is for no frills) total out to $5600.
Unbelieveable.
Folks, please, take care of these types of arrangements in a will. Everyone thinks they are going to live forever. We don't. Make sure that you have an exceutor set up to handle your business after you are gone. Keep it up to date. You don't want your loved ones to have to go thru this type of situation.
Luckily, I got HR here to give me unoffical (they are going to pretend they do not know) permission to start a collection to get this done.
Still, I wanted to get the word out about this type of situation.

She is co-owner of property worth several million on a normal market which should go to our son at the end of her time as well as the property we own together
But rethinking if we were both to die at the same time all our assets would be split between her oldest son and our son

We had to go through that when we moved from Texas to Alabama and it took six months to get the house sold. I left the thermostats at near extreme setpoints (50° - 80°), just a couple of small lights on, shut off water at my shutoff valve between the water meter and the house, and set the hot water heater to its lowest setting... paid minimum monthly charges for 6 months.
That kept the insurance in force for a couple of months until they figured out that we had moved, and then they raised my rates because "no one was living in it" and dropped the insured amount to the loan balance. They just wanted to make sure I had no financial incentive to consider something fraudulent like arson.
Yeah, I don't know Pete.. What I thought was doing was investing in my family finacial future.. This wast going to be the only house..But now.. it will be the only house, ever.. what a nightmare..None of this would be that bad, if the value of the house hadnt dropped below what I paid for it (50K).. and I only paid 50% of what the home was worth (110K) when I bought it. When I tried to sell it I was going for 75k, cover the loan, and repairs, giving us enough ( just enough ) to do the next one with out using a credit card.. Oh well..
Although I cannot blame the insurance companies from covering their butts it really sux that the honest people have to pay because of all the crooks out there that think of doing things like that to get ahead.
