Not sure what you mean by the fluid is slightly low, if its below the hash marks on the dip stick when at operating temp, on level ground & having been shifted into all gears before you checked it, top it up with Mercon V, to bring the fluid level within the dipstick hash marks & see how it goes. EDIT: Another thought, a tranny is a closed system & as such doesn't consume oil, liked an engine, so if the tranny fluid was low, it has a leak somewhere, so maybe its leaking from whatever is causing your 1-2 upshift woes????
So get under there & have a look-see.
Things that prevent OD: 1)broken planetary gearset 2) broken band 3)band strut dropped 4)servo stuck/broken or unsealed 5)valve body/solenoid 6)BOBO switch 7)speed sensor. Off the top of my head.

#8) Engine not warmed up enough to allow TC lock.
When you let off the pedal at 70mph, and if you let off all the way or close to it, that will disengage the TC.

It is in the hash marks. Albeit at the lower end of them but still well within tolerances. Hence me not seeing any reason to be alarmed.
No matter what, don't go to the shop that did the last two builds. Their stuff doesn't last, and they are going to take your money if you let them...

Precisely my thoughts. I'm actually amazed they took the poor old guy for the $$ they did. I sort of feel bad for the guy. He was an older gentleman that put a LOT of money into this truck (brand new motor, 2 tranny rebuilds, and countless other receipts). He finally had enough and sold it to me for dirt cheap.
I really can't imagine the O/D issue is a major problem given the 2 rebuilds. It has to be something simple/silly. Could the speed sensor have anything to do with it? I once pulled a code off it that indicated speed sensor, but it never returned once I cleared the codes.
A bad TPS can also mess up the TC lockup. Cruising, the tach will, on its own, show an increase in RPMS for a bit, then drop back to what was 'normal' for cruise. The computer is seeing a 'closed throttle' I suspected, and so it drops the lockup, and rpms increase.
If you get no lockup, and I *think* you should get one in 3rd gear, then add the TPS to the list of possibles.
A speed sensor dying would likely kill the cruise control. Had that happen also halfway back on a 500 mile trip. It might have even been dropping out of OD when that occurred. This was an AXOD trans.
