How you use the tranny has a lot to do with how fuel is consumed, how much is consumed, whether the engine is lugged or overrevved, etc. In short, if the EPA flexes enough, they could ban manual transmissions for one reason - they cannot control how a manual trans is used and therefore, they have less control over 'emissions' and other aspects of the vehicle than they want.
They want total control. They claim they are protecting the environment. In some ways they are. But to declare, as in the case with the preliminary motorcycle 'tampering' rules they are trying to implement, "any alteration beyond chrome or paint will cause the motorcycle to be deemed a 'custom' motorcycle... ...only one custom motorcycle shall be allowed in a person's lifetime..."
Say what???? What has THAT to do with emissions or the environment?
Reality is - nothing. As bihfla said, they simply believe we are all too stupid to know what is good for us, so they will be happy to try to fix us.
clux - you are right. The way the rules are currently written, almost anything you do that will alter (wheteher or not it increases or decreases emissions) the emissions controls of a vehicle make your activity illegal. This includes exhaust systems, whether or not you have a cat. Remember, changing from a 3 1/2 (necked down to 2 1/2), reverse-flow system to a 4" straight through system changes how the engine runs, and according to the EPA, that is illegal.
EPA wants NO TAMPERING, NO CHANGES, and if they had their way, we'd all be driving 4-seat gasoline hybrid cars or gasoline hybrid tiny pickup trucks - not diesel, EPA doesn't like diesel, despite how clean European diesels now are. Fortunately for us, so far, the courts have prevented much of the enforcement EPA would like to do.

IF they succeed, expect them to do the same thing with cars and trucks (it will be easier to set these rules in place against the small minority of bike owners first). Then we can say goodbye to custom trucks and hotrodded engines if EPA does what they want to do.
