Here in the Carolinas I would say 75% of the diesel trucks are deleted. The shops around me are still deleting them as we speak. That's all I have ever had is deleted truck's in the past. If I kept my vehicles outside of warranty I would be deleting them to if I got issues. But I would leave it alone till you get issues.

But they may try to impound it and keep it as evidence of a crime. IMO that would be a huge violation of civil rights and protections guaranteed by the Bill of Rights. It's just the government and 3 letter agencies have a history of getting away with stuff like that. Just look at the billions of dollars confiscated and kept from Americans who are never even charged, let alone convicted of the crime(s) used to justify the seizure. Just read about 'Civil Asset Forfeiture'.
I'm not aware of trucks being confiscated, but I'm pretty certain the EPA would have the guts to do it, and our court system would likely let them get away with it, if they choose to. I've never deleted a truck and never will, but if someone does and has any legal action taken against them, I will be rooting for the 'deleter'.
And evil if you wear a red hat too! So better watch it if you have a smoke spewing, loud diesel with an American flag on the back window and wearing a red hat.
General consensus is that it's just not worth the hassle or worrying about what might happen with laws down the road.
FWIW, I just became a Colorado resident and cannot register my diesel swapped Landcruiser because I put a medium duty engine (3.9 Isuzu) in a light duty vehicle. Had I put a 6.7 24V Cummins in it, I'd be fine.
My previous state of Oregon was kind enough to change my last registration from gas to diesel after I explained that I had put a diesel in it, but Colorado won't honor that existing registration.
Funny thing is that vehicle has a been running around Colorado for years after two military assignments here.
They do if you work them hard enough. There is no way around it without a DPF.
Yes but even then it should only be a light haze, not "rolling coal". The ironic thing is that a DPF works best on a diesel that is worked hard because the high exhaust temperatures help keep it clean.
My 12 didn't roll coal, but while towing it left soot on the fender and if it upshifts and then downshifts when accelerating like on the on ramp, it will blow some smoke. My 99 was not tuned and it would blow smoke at times under the right conditions. One time the timing was perfect with the boom box civic with a fart can that annoyed the hell out of me with the boom boom boom and FAAAAART. At a light they were sitting tailpipe to window, I floored it when the light turned green and the one and only time it rolled coal was right then and there. It was PRICELESS. That was back in 2004.
