You don't have to. You just have to tell him he doesn't own copyrights to that photo. He should bow out of the fight pretty quick. If he contests you just need to prove you have the original (I wouldn't send him the original, since then he has it too). But your copy won't have his watermark. The original may also have EXIF info, which was likely removed if uploaded to photobucket. That will identify the camera it was taken with, and only the original will have it unless it was preserved where it was uploaded.
Anytime anyone takes a photo, they automatically own the copyright to it.
If he doesn't comply, there are people to file complaints with; its actually a crime, not just rude.
