Not legal cause being 10ft wide you legally need a oversize permit to tow it on the hiway. With that your vehicle lic must be high enough to cover the combined weight of both your truck and the trailer and since the GCWR of your 1 ton is less then the weight of the trailer you can't legally raise it that high (and why would you?)
Now with that said, the good idea part. Depends. how far? how many hills? how many times will you need to stop? And since I don't know your skill level have you ever towed a 40ft trailer before? (like I said, I don't know your level so it is NOT intended to be insulting in any way)
Oh and lastly, what is the likelyhood of a DOT officer coming by as you do it?
I have seen it done in the past. Would I do it? NOPE. But then again I have access to a semi so no need to.

Yes I meant buy a fullsize van Dan.
As for pulling the trailer house with a one ton, yes, its legal, (in ND anyways) as long as the GVW on said vehicle is over 12,000 pounds( or is it 12,500). And you need to buy a moving permit to do it along with ovedrsize/wide lad markings. A couple flashing lights don't hurt either.

believe it or not rob, as part of my business, i got all the oversize permits for any moves we made. this way i knew they were filled out properly, and the routes were correct. and i always used at least one chase truck and at least one blocker truck when i moved those office trailers. DOT cops would see procession coming down the road, and just let us drive rite on by. only one time did we ever get stopped, and that was for a weight check with a D-11 cat on the trailer. we were something like 25 lbs under the max weight of the trucks tire rating of around 175,000 lbs with the "S" tags.

Tom when I had my own truck I hauled a lot of high wide and mighty and even had annual permits for 6 states. Occasionally even hauled super loads (over 14'6") which required state routing and double pilot cars.
My only point with him was that load would be wide enough to need permits if your doing it legally and then depending on state they would check to see if you had a US DOT number (iowa requires that and would have to look but IIRC something like 32 states require one before issuance of an oversized permits although some of them will grant waivers for one time moves like a house which I have also done)
With that said, usually DOT doesn't pay much attention if you have it flagged properly and have pilot vehilces also marked properly. In 6yrs I had to show a permit only a hand full of times and that was only on scales.

Well after sleeping on it I don't think I wanna bother. It is about an hour drive to get it and the biggest thing I'm worried about is having problems with the wheels and brakes on it, I mean its 40 years old and sat all its life so I'm sure the trailer brakes wont work and I wouldn't want the bearings going out as I'm halfway home, once I hook up it'll be my responsibility. Definitely not gonna hook up to something that big without trailer brakes and go that distance, and there's no way around going through a little bit of town which I don't wanna do. Guess Ill have to find something else to do to occupy my time and make some money on while I'm riding the unemployment train...

i hear ya Rob. in jersey anything over 10 ft requires a permit, costs $100 for each one way move, and the permits are good till 14'6" wide. in 21 years of filling out permits, i never made a move that was not 100 percent legal, and i only ever had to show the one for the D-11.
there were times i filled out 6 permits a day moving new machines from dealers to quarry's, and old machines back as trade ins.
but that was back in the good old days when you could actually make money running an escort service.
