You are not fine. The DOT classifies a tire approval based upon the complete unmodified tire.
Any modifications to a tire will not longer be approved by the DOT, thus is no longer considered legal.
You won't find a citation in most states that deal with cutting lugs off your tires. The department of transportation obviously certifies a tire on its un modified state, but most state codes don't address what to do once you modify them. If a cop writes you up a ticket it sure as heck wont be for cut off lugs.

Nope, false. You can burn off, smoke, or otherwise round off the leading edge of a bogger and they will still out perform any other dot tire off road.

I beg to differ. My dad runs boggers on his 74 bronco, the rear tires have every other lug cut off and the fronts have groves added to every lug. On the rear tires thelugs are gettin rounded. Memorial weekend after I broke my front ring gear I was wheelin in two wheel drive and was able to go just as many and in some cases more places than the bronco. I'm runnin Rockers.

How exactly did your subjective comment do anything to disprove my statement that boggers rule all other dot tires offroad
Knock yourself out buying a brand of tires from a small, new company that has not been proven.

I'll agree that boggers are best in the mud. But not everywhere else. I have wheeled on boggers, TSLs, and now these Rockers. I have never been happy with any super swamper untell I grove and cut them. So far the Rocker has performed better than I expected. Hands down in stock form I would pick the Rockers for all around off-road use. If I wheeled in mostly mud then yes Bogger.
I absolutely hate my Boggers when I get into ice or packed snow. My Iroks are much better in this situation. Sandy hills with gravel is not the ideal place for boggers either.
These are off road situations and conditions where the bogger is not superior.
All DOT tires have their place, and the bogger is really not the one tire that has it all.
Many situations I encounter where the bogger is not the best.
Heak take rock crawiling. Not many comp vehicles runnning the bogger. There is a reason for that.
As far as the burnout on a bogger, there might be a chance where it is still usable and maybe it is still better than an all terrain, but the tire is no longer as effective as it once was when it still had the leading edge and the cup in the tread.
To be as effective as possible, the cup can help displace much more mud than if the leading edge is ruined. Worn boggers just dont displace as much dirt or mud as a new one, and once the leading edge has been blown away the tire is just not as effective.
