I was wondering about the same thing. Here in MO, you have to show proof of current insurance at the DMV before you can get new plates or even renew your current plates. It's flat out illegal here to not have insurance. It going to work out ok for you in this case with her dad paying for the bumper, but what if it had been a lot worse?
Texas is the same. She presented insurance to the officer on the scene and listed it on the paper work we exchanged. The problem is, the insurace was for he father, not her. My guess is that the car, insurance, registation was all in daddies name. Insurance called to tell me the claim was denied because she was not the person insured, her dad was. No citations were issued at the scene, although the official report indicates she made an illegal lane change and illegal avoidance maneuver.
And you are right, if things had been worst and my vehicle had sustained alot of damage the girl would have been held liable. The insurance company told me to go to my insurance and file the claim. Then allow my insurance to go after her. I could have done that at the risk of increasing my own rates.
Instead I called her with another option. There is a guy in Channelview, TX (near Houston) that sells all the take offs from the Ranch Hand stores. He has a like new bumper in stock. Dad agreed to send me a check for the cost of the bumper. It was a good deal for him and he knew it.
Once I decide which way to go (stock replacment or aftermarket) I'll do the install and leave insurance out of it. I realize that is not how most would have handled it but having just dealt with insurance a month ago on two other claims I've had enough.
Hopefully she learns from this lesson and gets insurance in her name. Next time she may be saddled with garnished wages for life.

My dad was my insurance agent (in the biz for ~40yrs) and even he'd agree that there are times to not involve your insurance company. This surely seems like one of them.

Her dad made an attempt at not paying. He claimed that no citations were issued and therefore no one was at fault, therefore, we all pay for our own repairs.
After assuring him the police report read differently he changed his mind. Can't say I blame him for trying to get out of it. We agreed to talk again the next day. By the next morning he realized things were only going to get ugly (rental car, installation fees, and so on) once insurance got involved and he agreed to leave them out.

Correct, however that guy did not stop and neither the girl, me, or the witness that stopped got his plate number. The deputy that came to the scene said those exact words. That guy was at fault but we have no way of identifing him.
