Bascially if your pulling 1. trailer over 10k 2. truck or truck and trailer are more then 26,001 pounds your in cdl terroity. As far as derating a trailer, dot goes by what trailer axles are rated for, it does not matter if you derate a 14k trailer to 7k there still going to see it as 14k. The only thing with the trailer law is each state looks at it different in nj I can pull a trailer over 10k as long as combined gvw is under 26k, if I cross to ny or mass they look at it if the trailer is 10k and over I can be under 26k and still need a cdl. Personally I think it's better to be safe and have a cdl if your pulling more then 10k trailer because dot fines are very high and if they say you need a cdl you won't be able to move your truck until someone with a cdl can drive it for you.

FL does'nt care about the CDL on small pickups but they are another source of revenue. I am aware of DOT rules as I own my own trucking CO. VA is stopping pickups if they think they are overloaded and if you are and live in VA it's a $2500-3000 fine
