Yes please post what happens, I am always curious, AND GOOD LUCK with this. Personally I still think it was more than a bit bogus and would have been better handled in a different way by the officer in charge!!!!
Good thing I didn't get stopped the other day, Had the 24' gooseneck hooked on which is 7,300 lbs with a 5 yd dump truck with a 1000 gal. water tank empty however on the trailer about 12,500 lbs plus my truck with me in it 8,300 lbs. For a total of 28,100 lbs. Haha that is a bit of weight. I do drive my truck for business. Do you guys think I should consider putting truck plates on it? Thanks for the time and suggestions.
*-dmanlyr you dont happen to have a nephew named Isaiah do you? Sorry about that being off topic. Just was curious he is one of my buddies and has an uncle named david in the puyallup area.
i guess ill be the ***** and just say it...you broke the law...yeah you were un aware but it still doesnt change the fact that you did it...its your truck and you should be aware of the laws in your state...it sux that you have to go through this and that fine is definaltey large, and i would probably try and get out of it also, but hope for the best and expect the worse because very few judges are going to cut you slack for your own ignorance...everything is a learning expirience and im sure this wont happen to you again... ... best of luck and keep us posted...
(c) Commercial vehicle or commercial motor vehicle. For the purposes of
chapter 3 of this title, (driver's licenses), a motor vehicle or
combination of motor vehicles designed or used to transport passengers or
property if the motor vehicle:
1. Has a manufacturer's gross combination weight rating (GCWR) in
excess of twenty-six thousand (26,000) pounds inclusive of a towed
unit with a manufacturer's gross vehicle weight rating (GVWR) of more
than ten thousand (10,000) pounds; or
2. Has a manufacturer's gross vehicle weight rating (GVWR) in excess
of twenty-six thousand (26,000) pounds; or
3. Is designed to transport sixteen (16) or more people, including
the driver; or
4. Is of any size and is used in the transportation of materials
found to be hazardous for the purposes of the hazardous material
transportation act and which require the motor vehicle to be
placarded under the hazardous materials regulations (49 CFR part 172,
subpart F).
IMO: The worse they could tag you for is going over your GCVW rating, which should be a smaller fine.
There is more to the code than what you posted. The text you posted is just the requirements for a CDL and apportioned plates. Unfortunately in ID any vehicle with a stickered GVWR of 8001lbs or more is considered a commercial vehicle by weight and requires special weight fees to be paid upon registration. These fees are mandetory even if you do not need a CDL to operate the vehicle. http://itd.idaho.gov/dmv/VehicleServices/vs.htm
im not dening that i was overweight but when i registered the truck i ask if i need a commercial linc. plate, they said no and gave me an answer that ,now i know as a bunch of b.s.. but also ouch man thats a big f*@$%^& TICKET MY A TICKET FOR NOT having my road triangels!
anyone know the law in tennessee im gonna have to register my 97 f250 soon.this might be informaion i want to know ahead of time.
i will tow a goosneck with a 7000# JD tractor on it from time to time.
well i have to pay the 1600 fine and have a misdameaner on my record. What i know is that anybody, commercial or homeowner that have a regular registration cannot haul anything over the 8000 # mark that means hauling dirt in a trailer to do house projects, bricks in the back of your truck do do your walkway at home so its just another way of @^$^&*%#^* people that keep the economy going and to the people that pay for the wages its outragous !!! watch you back!!
I dont know about these other trucks but my 03,xlt,sd,exc,sb,5.4,4x4 with a full tank of GAS gos 6460# every time I cross the scales my gvw is 8800# but in Michigan if you get paid to drive you gotta have at least a chaufers lic,
