checked the fluid and did a filter change very little on the magnet fluid is some what dark and a little burnt smelling but not to bad over all i thought it might be a dislodged filter but that was not it

You say not bad over all, but what you wrote says the fluid is completely destroyed. That often indicates damaged clutches.
if it was a c6 i would not think twice about the fluid it looks and smells more worked that destroyed at this point i think it is down shifting to 2nd gear in the corner but do not know why

Maybe you're right, but in my experience once the fluid is dark and has ANY burnt odor the fluid is completely destroyed.
I found my problem there was a wire from the manual range switch that was rubbed through above the fuel filter it set a code yesterday outer cover on the harnes looked fine but the flex in the cab mounts and frame would push the frame through the split in the cover and ground out the wire thanks for all the ideas 2 trans shops and hours on here before i could find it. Just wanted to add THANK YOU FOR ALL THE GOOD INFO ON HERE AND THIS SITE!!!!!!
