you wont ever get a fine for it. if they dip it and it comes up red, next step is they have to test it.
it may be best to say "you won't ever get a fine for it in California" (im not questioning your knowledge of your state laws.)
it's good to see Cali has a simple method for a change.they dip,if they see "red" they test,and your on your way if it's just ATF.
it seems in Dave's state,they dip,they find "red" they tow,they remove the fuel,you go to court to prove its not off road fuel.

Since the highway use tax is 54.3 cents per gallon here in WV that adds up rather fast.
When they do a check, they stop every diesel that comes down the road, even VW Rabbit Diesels.
I have never seen them look at anything but fuel color when they dip tanks, so red ATF is something I would not be willing to run in my tank.
The tube they use has a green tint to it, so any red fuel tint appears black in the tube.
Black motor oil mixed in the fuel would look that same, so that is probably not going to fly either.
The boys that run the checks here are "WV Department of Tax and Revenue Criminal Investigation Division" and thay have absolutely no sence of humor about them.
SVO, WVO, WMO, home made biodiesel or any other non taxed fuel in the tanks, 5000 dollar fine plus court costs and a tow bill to a place to remove the non taxed fuel from the tanks in an enviromentally safe method and replace it with taxed fuel before the vehicle is driven on the road again.
Fortunately the check I see most often is always in the same place.
Unfortunately it is also in a place I have to drive through rather often since two stone/cement yards, a pipe supplier, two machinery dealers and three building material suppliers are all out that road off the interstate.
There is also a coal fired power plant out that way, so lots of truck traffic makes it an excellent place for a fuel check.
since i don't know how the law works in my state,i won't put ATF in my fuel.
however if i wanted,im sure a simple phone call to ask how things would be handled in the event of a check,would be the wisest course of action.
for me,it's not even worth the hassle of the phone call to find out.i just run diesel additives lol.
so true as it may be, you will never get a fine in Cali for red dye from trans fluid found in fuel,it may or not be the case in every state.
you may get fined,and then reimbursed latter,once you pay for fuel disposal fee's,court time,a lawyer,time out of work,and pay for the vehicle release from impound.
i just don't know what happens in Maine, and im that all that curious,so i don't do it.
Here it's the Ministry of Finance, and often if you are found with dyed fuel, not only can you expect a nice fine, but often they audit you, if you have a business that also gets audited, and often they will fine you for any taxes they think you avoided paying going back up to 7 years. I'll pass!!
