Four years ago my dad bought a boat from a private seller out of "Boat Trader" Magazine. He paid 10,000 cash for it and we got the title, transferred it and paid all the state fees and waited 9 months for the title (Ill dnr STINKS!!!). Anyway he gets a letter from the Illinois IRS saying that he did not pay the correct amount of taxes. Long story short, he calls em up and the guy from the state (who was a real jerk) flat out told him that the curency exchange screwed up and that in ill we have to pay the tax on the actual value of the boat, not what you actually paid for it. So at the time they said that the boat was worth 13,000 not 10,000. So according to them he owes them 1,000 bucks! The state official said, and this is what my dad told me he said was this: "sorry its your problem, not ours so pay up or face penalties and intrest charges." Then he threatened to take my folks to tax court to get the money if they refused to pay. This goes to show how bad those crooks are hurtin for money theese days. Man i really dislike this state!!!!!!!!!!!
That sounds just like NJ dmv.. I sold a car for 3800.00 dollars private sale and it needed some work.6 months latter the guy came to my house with a sales tax letter saying the car was worth 4600.00 so they wanted the difference in sales tax after writing them a letter stating it need some work and sold it as is..For the time and effort the state paid to have people work on this know wounder govt/state is going bankrupt.

Anyway, I feel for you. I have had the state under assess, and then change their minds too. It was on my home, and it went 5 years before we brought it to their attention. I still had to pay, but I didn't want it to go on too long. I later found out that they could only go back 5 years on their own mistake, so I should have let it alone. But peaceful sleep is important to me, so I wanted it made right.

The actual sales tax rate in ill is 7%. In chicago the tax is 9%. The actual amount he had to pay was $980, im not sure of the exact amount but that 980 has intrest added to it thats accrued over the past 4 years. Thats how they got that amount. Hes pissed but he knows that theres nothing he can do but pay up. Gotta love illinois!
Wow. It should truly infuriate you then that some of the new "appointee candidates" had to pay NO penalties on their "little honest mistake". In this case, it wasn't even your mistake -- I'd be flying off the handle too...
have a bill of sale . you owe what the sale was for nothing more . id like to have them tell me what a boat is worth . i can tell you one thing one boat of the exact model, used can very in alot . they depreciate quikly . one bad winterwization can take a boat valued at 20000 and with a cracked block be worth 10 gs . most of the money is in the powerplant . id call them out and tell them to prove what the boat was woth at time of the sale . bottom line is you owe for what the sale price of the vessel was sold for . id tell them to f''''''''off
this is like saying all 2003 f 250 are woth a certain price , ludacris . a vehicle is worth only what the market will bare . id go to ct and stand youre ground , you will prevail . although they will jack you around so by the end youll have more than a grand screwwing around . thats there selling point. i bet they say all the stuff they tax is within that same amount . knowing it will cost more than its worth to fight the crap . id fight it cause sometimes its not only about the money . Remember it costs them coin to fight it also . So is it worth it to them to fight for a 1000 bucks . or just try to scare the crap out of you and get the 95 percent of people to just pay the diff . Remember politics of today are all about scaring the crap out of people to get there way .

actually yes even in IL they are trying to bully you, tell em to take it to tax court and to send their assessors written statement of THAT boats value in a certified letter, notarized at the time of the sale to your attorney BEFORE anything else. They accepted the tax on $10,000 at the time, and you have title proving this and that will be your proof in court and the ONLY proof that will counter thier own acceptance is an assessors valuation of the boat in question AT THE TIME. This is the same tactic that collection agencies use, threaten with taking you to court figuring most people will fold and 9 out of 10 do so it pays, but the 10th won't and 9 out of 10 times it's not worth their time to fight it either.
In a tax court their acceptance of the value at the time has precedence of law behind it as proof of value and any good attorney can give you the several thousand cases to back it up.
I had a collection agency pull this same BS on me over a illegitimate bill from a hospital (long story but I did NOT owe it) kept hounding me and threatening with court and interest charges etc, told them take it to court or stop calling, they called back I called the AG on them and it stopped. believe it or not it works against a state IRS and DNR too.
My dad's exact words were "f--k that letter!" But after arguing with my mom and the nice phone call with the state they were like "Aww f--k it" and just sent them a check. Did they do the right thing? Well i think yes and no, yes they avoided all the bs and courts and lawyers (which neither of them wanted to deal with). But thats just the state robbing people of their hard earned money so they can have their precious tax money...rediculous!
One problem Jake that went into affect 2 yrs AFTER the sale of this boat, they can NOT make it retroactive. Also they have to PROVE value based on assessed values when it goes to court no matter what administrative rules put in affect (that is an administrative rule not a law big difference and will NOT stand up in court) There is several hundred federal precedent cases on this very issue, and unfortunately for Mr White he will lose against federal law and precedent. They absolutely rely on people NOT fighting it for fear of it actually going to court, if it goes to court and they lose they will then open themselves up to having to pay back millions of dollars and they can NOT let that happen as well as not being able to use it anymore. Ask the state of Iowa about deer damaged vehicles and them being livestock or wildlife, they would rather pay off someone then let that go to court.
