What Would You Do?

A couple months ago I had my truck warming up at 4 in the morning so I could go to the farm and milk the cows. I think it looks cool so I turned on my parking lights. Next thing you know I seen a Chevy S10 pulling in.
I thought it was the neighbors coming to complain about the noise. Next thing you know I go outside and it's some gangster boys tryin to get in and steal it. I chased them down the road and was probly 4 foot from their bumper with the beams on and a 12 guage in my hand .
The cops said if anything happened I would've been in trouble. But I aint the type to let people get away with stealin my stuff. What would you do if this happened to you?

Where are you located? A lot depends on that and the local attitude. But you generally have the right to defend yourself and property, especially in the situation you describe. You would most likely have gotten off if you were physically attacked. Say you were in fear for your life and weren't sure if they had weapons - self defense. If there was a gang of them it's perfectly reasonable to blast away if they were rushing you. Especially on your own property. Don't ever shoot them if they are fleeing. Here in NM we have a fleeing felon law where we can shoot fleeing criminals but it's difficult to defend it in court. Be careful because you very well could be on their hit list now. Do you know who they are? Did you get a tag #? Sick the cops on them if you can ID them. Scary stuff.

It's only legal to kill someone if your life is threatened by them. That being said, were you frightened for your life at any time in this ordeal? Perhaps a shot at the wheels might have been in order. Peppering the tailgate wouldn't have been bad either, would it? Don't know how the police would have handled it.

A couple weeks ago I had some stuff stolen off my work truck. I know, it stinks.

There was bout 3 or 4 gangster boys. I think they were black because When they ran across the headlights I couldn't see them. No offense to anyone this just p***es me off that I cant defend my own property. They were fleeing cause I chased them down the road at 90 mph. They didn't have a tag or if they did the tag light wasn't working. All I know is it was a white Chevy S10. Coulda just nugged them off the road on accident.

Not totally true CS John. If you are in a circumstance where a reasonable person would think they were in danger of being killed or suffering great bodily harm you can generally shoot in self defense if you are legally in possession of the gun. And you need to convince the cops of that. If they had gotten out of the truck and attacked you, no question you had every reason to kill in self defense. My CCW class dealt with a lot of the legalities and what to say if you ever have to shoot someone. Dead men tell no tales. A lot depends on where you are and local attitudes.

i would have propably peppered there tailgate, they aint gonna call the cops they were trying to rob you, and i doubt they would ever try it again, not with you anywhaz

I live in Rising Sun, Maryland. Its kinda rural here. But they came from a near by town I think. I aint had a problem with theifs since I chased them down

The issue is when YOU become the aggressor!
Also need to prove you tried to EVADE!
Above is the 2 biggest things you have to overcome.
A well placed first warning shot goes a long way.

With the economy going down the tubes this problem is growing by the day.

from what iv been told if a warning shot strikes them you can be in deep ****, if you perposuly shoot them in a non lethal manor it shows that you did not feel that they posed enough of a threat to you to warrant shooting at them at all. but law aside i still would have peppered there tailgate, i really doubt they would be going to the cops. but if you strike them and they go to the hospital doctors ask questions. of course a warning shot fired 20 feet away from them probably would be fine. im no lawyer though. however when i was living in ky i had a guy try to break into my home while i was inside i grabbed a golf club as they were trying to break the door in and smaked him 2ce before he took off running the cops said that i was within my rights, although i did chase him about 2 blocks down the road, but i dident strike him after he started running just swung open the door and pop em twice without asking any questions

ya, i'd have tried to "mark" the vehicle.
Madvan is right, at least in most states i know when you become the aggressor, you become responsible.
Had you started shooting when they were coming "at you", you could have got off on self defense.

I agree. I have my CCW license too. I think some of the laws vary from state to state. In Ky, there is a lot of gray area and you are correct, dead men tell no tales. In Ky, if in doubt, the law favors those with the CCW license. At least it's suppose to. John

Jethro, how big of a town are you in? If its pretty small there wont be many White S10's... so if the police are trying, they'll find them

I was goin to pepper the tailgate but they backed out of my driveway and I wanted them to feel the International eatin up their tailgate. lol I would have shot while driving. But a 12 guage with 00 buck shot and a 4 foot barrel equal lots of recoil. Shootin with one arm would've hurt me more than them

you could have always yelled somthing at them that would make them turn around and shoot em...lol that way the bullet holes would enter from the front, just make sure you leave no surviors dead people cant talk...lol
