the trannies my problem because there wasnt insurance on the truck. i tried telling them the truck didnt have insurance because it was parked for the winter, but they said they cant do anything because it didnt have insurance at the time. so now im stuck with rebuilding the tranny which was just done a couple weeks ago.
This doesn't make sense to me. If ya tell the courts that the vehicle did not need insurence because it was being repaired and was not going to be moved from your personal property until this idiot stole it then I would think ya should be reimbursed. Does anybody else see this the way I do or am I way off base?
Still, from my point of veiw, why would this theif try to steal such a unique truck that could be easily spotted??

im as confused as you are, yes i think you are right on but because the kid was under 18 and the truck didnt have insurance thats all they can do. i was told the reason that he stole the truck is because he wanted to give it to his father for his birthday, so the moron came and stole it.
I would think his parents would be held responsible then. A buddy of mine sued the parents of a kid who bashed in the door of his 350 with a tire iron and he won easily, with no lawyer. He just explained to the judge what happened and presented the repair bill as evidence. Kid said he did it cause he "didn't like Fords." Give the theif's dad a nice birthday present, a repair bill.
Seems to me that if the kid can't pay for the damages that his parents should. At least that is what happened to one of my friends years ago. He was under 18 and damaged a car with his moto-x bike (tried jumping the car and landed on it instead). He didn't have the money to pay for it so his parents had to. I don't recall if the car owner had to take him and his parents to court, but they ended up paying for the damages that he did.
I would check with you lawyer. Depending on the cost to rebuild the tranny you may have to go through small claims court.
That would be my suggestion, persue this in small claims court if possible. Bring the this against him as a minor, but make sure that you hold his parents responsible since they won't go after him since he is 16. Even without insurance they would still have to pay to repair it, there was no insurance since it wasn't being used til next spring.
i just got off the phone with the lawyer and he says we could take him to court but since the rebuild will cost 600.00 we wouldnt get much more than that and id be losing money becuz of the lawyer fees.
I'd STILL go to court and sue him for damages + court/lawyer fees, since the whole mess is his doing. I'm surprised your lawyer isn't jumping on this cuz that'd be EEZY money. Your labor to replace the tranny and re-install it, plus a trashed Stage 3 centerforce clutch and brand new flywheel only comes up to $600? Someone isn't doing their homework here...

im gonna take em to small claims, this price didnt include clutch or flywheel. even if i have to hire another lawyer that will handle it im takin it to court.
