Talking How long before I get evicted???

OK, I'm moving. Giving then my written notice with this months rent. These people are such door ***** I'm sure they will try some crap. But I'm prepared & had fun writing my move out notice.

January 2, 2005

To Whom ever it concerns,

This is my 2 month notice. I will be vacating Apt. #103 & Garage #4 on February 28th. 2005. There are many different reasons for me doing this. The main reason is that I no longer need the apartment & the other is the caretaker. I am no longer able to tolerate him. He is nosey & into everyone’s business when he has no right to be. I have also been told by other residents that he is telling them that my apartment is such a mess that you can’t even move in there. That statement is far from the truth.
In June 2004 he removed a window out of my main bedroom because he states it was broken. When I left town earlier that week it was not broken but I took his word on it. Still to this day that window has not been replaced.
One wall in my apartment that is next to the utility room (boiler room) is stained yellow. Apparently from a water leak that I can only assume is from poor maintenance on a boiler. The ceilings in the bathrooms are falling apart & peeling. They have been like that since I moved in.
He is also a thief. Last Winter I had 2 snow shovels on my patio. Both of them had purple scoops on them. One day they disappeared. I asked Tom at that time if he had seen them. He insisted that he didn’t have a clue where they were or what they looked like. Well yesterday Jan. 1st. 2005, I walked outside while we were having a snow storm & there was Tom shoveling the side walk with my snow shovel.
He also has a problem with visitor’s parking in the lot. Now I completely understand that. The sign says no visitor parking, so they shouldn‘t park in the lot. But, if they are coming to visit him they are allowed to park where ever they please. If a tenant mentions something to him about it, then he gladly opens up a vacant garage for his visitors to park in while they are here. Hey, if your giving away free garage space to visitors, then why am I paying a extra $30.00 a month? And I’m a tenant.
Snow removal is also another issue. I don’t understand why the parking lot is not plowed & deiced at appropriate times after a snow storm. Jan. 1st. 2005 we had a snow storm. Notice just went up tonight that the lot will be cleared on Jan. 3rd. 2005. That is 2 days. The parking lot is already packed down with the cars moving in and out. And why doesn’t the parking lot get sanded or salted? This building is primarily occupied by the elderly. What would happen if they slip & fall trying to make it across the icy parking lot?

That letter was written very poorly. Not once did you tell them to shove it, where to go and how to get there and what they can do with your last months rent. Re-type and re-submit.

Straight and to the point. I know where I am from the demand for apartments is so high that they would look at your letter as just . Sounds good though. I hope it helps others there.

I know. I ran out of room though. I only wanted one page not a novel. Besides they still have my security deposit that I'm sure I will never see again.

I'm sure they will look at it like that also. But They have alot of people moving out because of the same reason. If they say something, I'm not sure.

This past August he got on my case for BBQing. I asked what the problem was. He says that Gas BBQ's are not allowed on the property. OK, I understand that. But I BBQ alot & have been here a year, your just now telling me that.


I don't need the Apt. anyhow. I have a Peterbilt 379 to sleep in & if I don't sleep there I can be at my Mother's (which is in this same building) or at my Girl Friends house (yeah, I think I got one of them also).

Well, I'd say your letter pretty well lays the facts on the line. Whether it phases them at all, and in a positive manner is another deal. If you're absolutely convinced that you're not going to see your deposit again, then let em have it. On the other hand, if you're not convinced you'll loose your deposit, simply tell them the date you're going to vacate on and nothing else. Why are you giving them so much advance notice? All states differ on the time; here in WA a standard lease agreement requires a renter to provide 20 days written notice (unless something changed) before the end of the month. A month to month lease can be terminated at the end of the month by either party with written notice provided by one party to the other; the 20 days still applies. Agreements different than what I noted are possible, provided they don't conflict with state law. Another thing to remember is that other than law, agreements must be in writing and signed to have any weight. The rest is just .

On evicition, all states vary. Where I'm at, there is a three and a five day eviction. It's usually reserved for deadbeats that don't pay rent and those that create a living hell and cause problems for the neighbors. Most landlords don't really want to evict you if you're paying on time; it's a bit of a hassle and they always face uncertainty with a new renter. Several of my buddies are landloards. They generally try to avoid eviction whenever possible; as a group with about 20 properties they average maybe two evictions every 10 years. Non payment of rent, AND with no hope for payment, is usually the breaking point. The normal method my buddies use to encorage a problem renter to leave is to raise the rent to the point that they go shopping for a new place to live. My buddies "always" give the renter a good reference as they want the renter to leave.

Back to damages, did you do a move in checklist and did it make note of the stains and ceiling problems? If so, you've got a few good cards in your hand. Remember now, state laws do vary. If you don't have a check in list, all may not be lost. About a year ago I person I know rented a property; upon vacating the landlord (a drunk) accused they guy of doing all sorts of damages that actually existed at the time the guy took posession of the property. A little visit with a lawyer was of great benefit. No check in list, signed by both parties, implyed that the landloard could not prove damages in small claims court (the road the landloard wanted to take). After a few months of complaining the guy told the landloard that he screwed up and that if he wanted any money to "take me to court; I've already contacted my lawyer". The landloard was never to be seen again. BTW, the BBQ thing is too funny. Most landloards are more concerned about fire with charcoal types of BBQ's, gas is not really a worry. If the landloard didn't put that in writing and have you sign it I'd expect he has nothing to stand on. If you're again convinced that your deposit is gone, I'd call a few buddies over in the middle of February and have a going away BBQ .

My lease expired over a year ago, since then I've been on the moth to month basis & have always paid ontime. I'm giving them 2 months notice of vacating as originally stated in the lease. Besides it will take me that long to get everything packed up & moved out since I'm only here on weekends.
