I heard that Ford has the patent on the taillights or something like that

Why do you want an aftermarket tailgate? The brake lights are not part of the tailgate, they are a part of the bed. The think the difference between the styleside and flairside(supercrew) tailgates is probably the width, since the flairsides are more narrow. But I'm not 100% on that, you should try to get a meaurement of yours and then on a styleside.
Yes, the SCrew tailgate is the same as the Flairside (Stepside). I believe the tail lights are also interchangeable. You can use the Lightning pieces if you want.
Yea, that's right. Flairside and Supercrew tailgates are the same, but are they the same as the Styleside (no fender flairs on the outside of the bed)? The brake lights are definately not the same on the stylesides as on the flairside/supercrew.

to replace it with, I can not find, aftermarket does not have, Ford has a patent on the size of the tailgate and the aftermarket can not make or something like that, is what some people have told me.

I can't say I have ever seen an aftermarket tailgate besides the net type and the 5th wheeled louvered type. The flareside, is the same as the super crew and so is the explorer sport track (I think it has some extra holes for the additional lower trim piece). Is your truck a 4X4? If so, there is a pin that protrudes from the rear sill and a bracket on the bottom of the tailgate that engages the pin when the gate is opened. This prevents the tailgate from shifting side to side and becoming detached when in the open position during off-road use. Be sure your new gate has the bracket if you have a 4X4.
