Not sure that shut off conforms to FMVSS but I will be changing mine eventually.

only reason I can see for turning off the brake lights is if you're hauling shine and the revenuers are after you...

For the OP, I would check with the local MVD as to what is required per state law.
I've always wire the brake and hazard circuits hot at all times where the brake light switch and hazard switch complete the circuit with the key off.
On the newer cars with push button Start, the start circuit is not active until the brake circuit is complete by pressing the brake pedal

The line is definitely hot whether on or off. I'm still trouble shooting it here and there to no avail. I'm going to run a hot line all the way back the the brake lights this weekend.
