If I didn't tow a trailer close to the weight limit, I'd be ok with it.
But in this particular instance, with a structural /safety component it is not acceptable to me.

NO! but you have to know what you are getting! no one has any way of knowing what the hitch at the junkyard went through before someone else receives it. The hitch is also a rear impact bar to keep the vehicles from going under. I also would want new!
Ask the insurance to sign a off that they will be responsible for anytype of failure associated with the used hitch. I can guarantee you, you will then get what you want!
