That's actually not true. Go to Kragen/Oreilly and look at their Dex/Merc fluid. That stuff meets several different specs, and it will cover the MERCON spec. Not that I would use that stuff anyways, but you get my point.
Actually it's quite true. MERCON has been discontinued. NOBODY makes a fluid with the MERCON spec. There are many, many fluids available that say they meet Dex/Merc specs.
When MERCON (and DEXRON) were in production Ford (and GM) certified each fluid that said MERCON (or DEXRON) on the label. Now that both are obsolete fluids NOBODY certifies them. A manufacturer could (not saying that they would....) take ANY fluid and say it is for use in transmissions that required MERCON/DEXRON. Do they actually meet the now obsolete spec? I don't know. I do know that if I use a fluid that says MERCON V on it that Ford has certified that the fluid actually meets MERCON V specs.
