Fluid will not get cooked towing, as there are no clutches being engaged. The damage would come from bearings and the rear planet (I think, not too familiar with the E4OD power flow) spinning without being lubricated.
How would you tell? Is there a certain sound or something?
So, a 2wd ZF5 needs the shaft disconnected? I am under the impression a 4wd ZF5 truck can just have the TC put in neutral to safely tow.

That's what they say. For shorter tows I'd feel OK about that, but for long, higher speed towing I'd always pull the rear driveshaft. I met someone fourwheeling in Colorado once who was driving a rental Jeep. He had flat-towed his built Jeep up from Texas and lunched his transfer case. I know it was a completely different transfer case, and I'm comparing apples and oranges. But as far as I'm concerned it's just cheap insurance.
