You need to know what you are talking about before telling someone they are wrong. I know it works. I don't wade in and give advice if I don't know what I am talking about. I spend a lot of time reading and learning but not giving out false information.
I bought my daughter an 01 Escape that only came with one key. I took the car and working key to Home Depot and had them cut and program an aftermarket transponder key for around $50 that has a lifetime guarantee. I then ordered a transponder key from Amazon.com. I took it to Home Depot and they cut it for free. I then followed the instructions that came with the Amazon key and programmed it to the 01 Escape. All three keys work.
Take your Escape and your working key to Home Depot and ask. You have nothing to loose when they are giving a lifetime guarantee with the new key.
1) Ford Factory Service documentation unequivocally states that two separate programmed PATS keys are necessary in order to program additional keys.
2) The HD key is a "clone" since they did not go out to the vehicle and program it in with an appropriate scan tool. They use this machine: EZ-Clone: Hillman Group
Either Ford's official service documentation is wrong or there is some other unknown factor present in your 01.

Tennessee did say that Home Depo programmed the key. Maybe his HD store has the scan tool...or maybe the previous owner hid a transponder key under the dash.
