well i talked to the dealer today and they confirmed that the truck was sold at auction less than a year ago maybe 10k miles and that they recently bought the truck at auction themselves. i told him the concerns i had not knowing what was done to the truck or how it was done. also told him that from what i could tell most all of the emission components had been removed and would cost $4-$5K to replace, he didnt care and said they had it priced to sell. i just hope nobody ends up with it not knowing what they are getting like i would have. is it illegal for a car dealership to sell a vehicle with the emission control devices removed:?

Depends... Does WI have emissions or smog testing on Diesels? If so, then they would typically put a new inspection sticker on the truck when they sell it, if they do "pass" the truck, and there are regulations on Diesels in that state, then that would constitute fraud and that would be the extent of their legal troubles as far as I know.
Again, I'd walk away. Especially since you know what you know now. With the lack of OEM equipment, that truck is NOT priced to sell. I don't thing $26K is really a good deal for a 2008 with 100K miles. Too many unknowns. It wouldn't surprise me if a dealer, or that dealer, removed the tuner in hopes that some naive individual would buy it and they don't have to worry about it.
Their website states that "Warranty is Available." To me, that's dishonest, no warranty company is going to pay for repairs since the truck is modified. You MAY have a small argument that you bought the truck that way and bought the warranty to cover the truck "as is," but if they deny a warranty claim, are you going to take them to court?

Is it even legal for a "dealer" to knowingly sell a vehicle that does not meet Federal emissions. Just because the state or locality does not test is not make it legal. I do not have an issue with deleting but I am also not an automobile dealer. There must be someone from the industry on here that knows the regulations. And according to the OP this is a franchise automotive dealer, not some used buy here pay here car lot.
Yeah, I bet the truck is tuned and dileted. The AM tailpipe is the first violation of the clean air act. I'm betting someone tuned it deleted it put on an AM exhaust and probably an airbox then pulled the tuner out and sold it or traded it to some unknowing soul. Given everything else that's in the Clean Air Act I would bet a dealer selling a vehicle with a defeated emmissions system could be in a heap of doodoo if caught. But we are such a small number of vehicles that few people know anything about the emissions on these trucks. Apparantly even some used car managers. Funny part is the tuner is not worth anything until reverted to stock on the truck, at least most of them aren't.
