Thanks , been running rims with 4.25 also for 20 years with no problems . Just want my truck fixed , just got off the phone with the auto shop and waiting on estimate which was done yesterday , now the appraiser is not getting back to us .
Yes no doubt , discout tire is the insurance , so far I have two emergencie visits , medication , car rental , pain and suffering , broken truck , loss of two weeks of work . So if they fix my truck , pay the car rental , hospital bills , loss of wages and something for pain and suffering I would be happy . If not I will have to get an attorney which would take more time . So what do all think would be reasonable for this situation ?
To me, they should definitely have to pay everything you have listed. I've only been involved in a couple of situations that weren't my fault and when I went along with the insurance people and didn't raise a stink they gave me a little extra for not suing. So I would suggest being nice until it's time to not be nice. LOL
If they pay all your bills as you mentioned and get your truck fixed back to original condition, I think that would be fair. I don't see you getting much more in court. Now if they say we aint paying squat, then lawyer time.
Ken,
Glad it was no worse for you and your truck. I don't want to sound like an ambulance chaser, but GET a Lawyer, hopefully one that you feel comfortable with. Insurance companys will settle with you for as little as possible. Let the lawyer fight for you and do the legwork. His fees will come out of the settlement. Insurance companys know if you have proper representation, they will have to payout more. You won't get screwed. (at least not as much) these things always suck. I speak from experience. Its only for your own protection, you could have back problems later down the road, once you sigh off with the insurance company, you are stuck with any future problems and bills. Good Luck!
And be doubly careful of what you say to them (remember, they like to record EVERYTHING) and especially what you sign. Don't let them pressure you into agreeing to anything or signing anything.
Simple truth, the insurance company isn't your buddy, its not your friend. Their whole mission is to get out of this as cheaply as possible and they really don't care what happens to you.
Like 78longbed says...get an attorney.
sounds like a story from ron white. That sux about your truck though. I would be uberly pissed if that happened to my car. I would be getting everything i could from that company. I hope everything turns out good for ya though.
I am waiting on the offer this week from the ins co . I really hope they do something soon. I had to do a recorded statement last friday . The tech at american/discount tire stated that the suspension on the front driver side looked freshly painted and the fender and that I had talked about doing suspension work . This was not true and I told the tech I was wanting to do air ride up front some day . They also mentioned I had brought in my own wheels and tires to be switched out in the past but this time I brought my truck in for them to swap out the new wheel . My work didnt fall off . But the one they did fell off . So patietly waiting and said this statement was not true about me working on my truck after they installed the wheel , sounds like they are trying to get out of this one .
Ken,
I know it is an uneasy situation. You try to be a reasonable person and do the right thing, hoping that they will also. Believe me the nice guy aproach does not work. Unforntunally its all about how little they can pay you and make you go away. You will have to fight with them just to get back to where you were before the mishap, which was their fault. This happen to my familly, an old man plowed into me in a big old boat. It totalled my wifes 1999 Bonnieville Supercharged SSEI, which was cherry and well kept. The old man lost a headlight rim. They would only give us book price for my wifes car, and I had to fight for that. My sons X girlfriend had back injuries and still has not settled with the insurance company yet, My family has settled with the insurance company, which was over 3 years ago. I got an attorney to protect the X girlfriend and my family, My wife had minor injuries as well as my son, I was OK. Bottom line is your world is turned upside down and they want you to settle for what they deem is fair to them. So we inherited a NEW car payment that we really didn't want at the time. I'm not trying to sound like your parents, but I still recommend that you get an decent Attorney, you have to protect yourself. Thanks for keeping us informed, Best of luck to you!

I concur. No matter how nice the adjuster is, or anyone else at their insurance company, their job is to get out with the least amount of expense as possible. They could give a rats azz about how you or your truck are. Injuries take months if not longer to show up.
Look at their offer, take all the time you want to, consider everything, cost to put your truck back, doctors bills, pain, etc. If it doesn't sit well, don't agree. You can't go back later and ask for more money or complain, they don't care. Think of them as a crook in a suit.
Yes you are all right , they denied the claim and said i worked on my truck after the fact . So getting a personal injury lawyer now that they wont help , does anyone know if I can fix my truck while waiting for a lawyer ? I have no vehicle now and have to tow her home this week , the shop charged me 100 bucks for an hour work .
Ken, I wouldn't work on it until you see what your lawyer says. I can't see anyway that they could get out of paying for a rental vehical for you, no matter how long this drags out. They put your truck out of comission, a rental is the least of their worries after you go after them legally. Keep us informed, Good luck! And make them pay for the storage and tow. Don't leave out anything, It's a shame that you have to fight with them, just to get back where you were before THEY forgot to tighten the lugnuts.
man, this reminds me of when we put the rebuild motor in our 65' after it sat for probably twenty+ years, started going down the road 35-40 (this is in a 65 4x4) and all of a sudden it felt like we hit a super big pot hole (here in MN, thats not uncommon) and we saw the tire pass us up. we lucked out and to this date we still havent gotten a new lock out, turns a little hard but still works (hehe) but we were on a back road so nobody got hurt, and sorry for the hijack!
