No, I inserted the nozzle but didn't activate it before I somehow noticed it. Replaced the nozzle and took out the other one.

Unless there is something that I don't know about, there is no difference between off-road and on-road diesel, except for the dye. What are they looking for by swabbing the tailpipe to find off-road diesel, besides soot? It shouldn't burn any different than on-road, unless your provider still has low-sulfur farm diesel instead of ULSD, than you're lucky!

Diesel and off-road are the exact same fuel at the rack, just one has a dye. I've been known to run it, esp during a hurricane b/c its legal. So I'll try to milk that for as lond as possibel, but eventually switch back. The police dont check much round here.

I've never been tested for off-road fuel so I can't say myself, I've just heard of it. The swap they run through your tail pipe must react to the dye in the fuel I'm guessing.

I've always wondered what would happen if you refused to have your tank dipped. After all, it can be construed as illegal search and seizure, right?

Say a cop pulls you over for speeding, they can ask to search your car, but you can legally refuse. However, they can "look" into the car and see if there is anything obvious sitting on the seat or on the dash. Technically, they just observed something without searching, and can do it without ever touching your car.

However, dipping the tank is searching. That's not casually observing something without physically opening up the car and fishing around.

So, I'm wondering if anyone has ever tried to refuse having their tank dipped, and if so, what happened?

You know the laws and so do they. When you go in front of the judge, who do you think he sides with? When I get a speeding ticket, it is my word against the cop's too.

You are right. "OMG. I smell pot!!", "You seem to be slurring, are you sober?", etc, etc.

If they want to bust you, they can claim they saw a red drop of fuel under the car or truck or whatever. I'm convinced that they can make it up as they go along. Friend of mine was busted for speeding. He argued that the truck in front of him was moving below speed limit so he could not be speeding. Cop said "OK. Here is a ticket for running a stop sign. See you get out of that one.".

I was dipped once on the side of the road in Washington, got pulled over for pulling a trailer in the left lane (not legal in Washington on a 3 lane HWY), after writing the ticket he called a DOT inspector in, dipped my tank, checked my trailer and wrote me another ticket for a side marker light being broken (still lit, just the housing was broke)

I have been dipped twice on the jobsite, but they are not local, or state inspections... This was by the FED's. Federal IRS agents. If you refuse they will come back with a warrant within hours as my dirt worker found out later. The FED's will not dip personal trucks on these inspections (good for my asst super because he had red on board) but all company trucks got the dip.

She pulled my fuel cap and the fuel was right at the top of the lid... gravity tank at work! She didn't even dip it that time!

I have never used it either nor have I ever been tested. I just get to wandering sometimes about stuff, and thought I would ask. Thanks Jim

I was always under the impression that off-road was untaxed and that the only thing that is different is the red dye. Anybody know?

It's all the same diesel, just not as taxed. With the way the government is coming up short on money to repair the roads in this country I wouldn't be surprised if they started dipping more tanks...

Just my .02. I've never been dipped but I live in San Diego so it's hard to find the dyed stuff to begin with. Now if I lived out in the farmland...
