It is possible that the dealer is making up this story about "engineers being aware and can't fix" to deflect the blame from themselves not being able to fix it quickly...
Searching the Internet, have you found even one or two other instances of this problem? There are probably 20,000 or more 2009 Escapes on the road already using this transmission, and RR's problem started at 300 miles.

Read the original post again. RR03 has had "direct" contact with Ford Motor Company about the issue. I know this for a fact.
If the field service engineer documents the problem which they did and sends the data to FMC in Dearborn. If there was a fix, the dealer would be informed of the fix. They don't care, they get paid for the warranty work.

"Ford Motor Company" is a pretty big organization, and my relative is involved in new production and design areas, whereas this may be more of an issue for field service although I would certainly think that new production folks should also be aware.
In my own experience, what a service writer or manager tells you is not *always* the total story.
I certainly hope that this new transmission design does not have problems over the long haul like the 5R55W or mod motor spark plugs... I am always rooting for Ford to do well and this would not help.

The shift flare problem is out of the dealers hands right now, it's up to FMC! What the dealer stated appears to be correct if RR03 is talking directly to FMC now.
The fluid blowing out of the fill tube is another story.
I retired from FMC this year, worked where they build the 6F35 for about a year or so. Any contacts I had at the Van Dyke Plant are long gone also. I'm about 45 minutes from Dearborn too.
Listen, so many people complained about the CD4E transmission in older Escapes, but nothing like that every happened so soon with the CD4E. The CD4E properly maintained is a decent trans. AND, putting the correct fluid in it will surely make it last longer. It is so easy to change out SOME of the fluid at each oil change, dont know why more owners of Escapes dont do this and keep the CD4E purring. Dump 4 quarts of the old fluid and add 4 quarts new, I do this every other oil change, takes 5 minutes AND use Mercon fluid ONLY, not Mercon V like is says on some dipsticks. The CD4E is designed to use Mercon and Mercon only. I did hear that the new formulation of Mercon V is backward compatible with Mercon, maybe, maybe not, but as long as plain Mercon is available I will use that only.
What is it with this new transmission? Is this the new 6 speed tranny Ford has out? To me it sounds worse than the problems people were having with the CD4E..at least the CD4E could be repaired in some instances.
I just had my 09 ford Escape to the dealers with what we thought may be an oil leak. We were told it was transmission fluid & they drew it down. When it happened again, we took it back, they put die in the oil, but discovered it was transmission fluid - again. Now they are telling me it is that the wrong dipstick was installed & they've ordered a new dipstick for me. I plan to take your information with me with my next visit. Thanks for the info.
I haven't experienced this flare condition with my 09 auto tranny yet, thanks for the update though as I will certainly be more sensitive to this potential condition.

When it happened again, we took it back, they put die in the oil, but discovered it was transmission fluid - again. According to my Dealership Service manager, there is a TSB out on this fluid blow-by problem.
I to have the same problem with my 09 Escape. The Escape was purchased in Oct 08. The second day after the purchased I had a trans leak. After checking the fluid, I found it to be approx 3" over the full line on the dipstick. Although it was obviously leaking, I could not find the source of the leak, so back to the dealer to start the long journey of trying to fix the leak. Dealer drained the trans to proper level and said all was ok now. Well I would not be here if that was the case. 2nd trip to the dealer and I'm told it has a bad oil dipstick tube and needs to be replaced. Now at 12k I bring it in for the 3rd time since leak has not stopped. Dealer contacts Ford and is told that they have a new dipstick tube being designed and it's on national backorder. Ford tells the dealer to lower the fluid to the add mark on the current dipstick and it will solve the problem. Another 3k and back to the dealer for the new dipstick and oh guess what, lower fluid level still did not stop the leak, but now seem to have slippage between shifts sometimes. Did the orginal poster ever get his 09 fixed. I've always been a Ford owner and have had at least 17 different Fords over the last 25yrs and never once had a problem like this. My patience are running thin and think I now am going to start the CA lemon law procedure. Anyone have CA experience with that. Thanks Jim

I am the original poster. Yes, I finally, after two transmission changes, the problems I was having were resolved.
The fluid blow-by was supposedly caused by an over sized bore in the tranny...at least that's what I was told by my Dealer. There is a TSB on the fluid blow-by problem.
Be patient, it took three months for my Escape tranny issues to be resolved.
