That dosen't suprise me on bit Mark. Quite a few years agp I was on the NJ Turnpike. I got my ticket where i got on, flew down the pike paid my toll. Then got pulled over and was issued a speeding ticket. They calculated how fast I was going by the ticket times and entry and exit points!
Thats another crazy comi state, no offense to my bros and sis living there. Over here in pa. they do the same thing, check toll booths to see how fast your getting from point a to point b then they patrol heavy in that area to nab speeders. Good old fashion police work, lol.

Oklahoma has been doing this on their turnpike for as long as I can remember. 30 or 40 years I'll bet. I've never been caught by it, but just been told of it second hand. The 2 speeding tickets that have really annoyed me were both awarded to me in my Corvette. One in Illinois that was by aircraft (which would have been a good hear say defense) and the fine had to be handed to the cop right on the spot in cash because of my out of state plates. The other was in New Mexico. This was for 100 mph in a 65, but it occurred at 2:00 a.m. and there was no one on the interstate but me and that cop that was parked on the shoulder of the road with his trunk up to hide his bubble gum machine. He made me follow him to the Justice of the Peace's house in this little hamlet, got the Hispanic judge out of bed and tried me right there on the spot. The judge with the droopy long moustache asked me how much cash I had on me, asked me where I was going, asked me my mpg, got out a piece of paper, figured out how much money I needed for gas and took the balance.
The state I was pointing to is NY, they will do anything for money. They even have a "Department of Creative Taxation" in Albany. It's a think tank where whiz kids sit around and dream up new ways to tax the public. But anyway, I've never seen it, but a bunch of us were hanging around one of the Indian Reservation fuel stops discussing the pros and cons of using the dyed fuel and someone mentioned they had heard that the State Troopers were going to begin randomly checking any and all diesel vehicles with a special chemically treated swab. Kind of like a DNA check.
Then I would say that I was working off road on a strip mine site 4 months ago and that's where it came from. There's no law against running off road fuel off road and then going green when you're back on the highway.

I agree with you but I don't think the law does. If they can detect the red diesel in your tank, thats all they need. I'm sure they don't care how it got there. .02

I'd say you can definitely fight that one. What if (like was mentioned before) you aren't the truck's original owner? They can't define when the red diesel was used, how can they be sure it was you who did it? You can't be prosecuted for a crime if they can't prove (without a reasonable doubt) that it was you who ran the untaxed fuel.
I am of course talking about Mark's comments about "swabbing" the exhaust.
That is total BS! I have a hard time believing that is legal.
Well, I think it's sinister, but I have no problem believing it's legal. It's every bit as valid as using radar to measure speed.
What you have to do is go 90 mph for a while, then pull over and take a beer break, then get back in and drive 90 the rest of the way. As long as your average speed doesn't exceed the limit...

I think if they're magic swab indicates the red dye, the next step would be for them to dip the tank. If they find red fuel with the tank dip, that's all the proof they'll need.
Thats like Halliburton used to tell us while taking a drug test. We don't care what you do on your days off, just don't come on the property with it in your system.
It takes around 3-4 fill ups to flush the system from red diesel. After the storm Rita all we could get down here was red diesel. The gov. told us it was ok to use it till we could get regular diesel. Don't worry, we were taxed. lol We had a certain date we had to be flushed out. And this was all the stations here. At least the ones that didn't have too much damage and could still use the pumps.

But what if you arent running red, and the swab still indicates? Perhaps red had been used a few or maybe 10 tanks before..
I hate excessive regulation, and how inventive police/city/state/municipalities have gotten to basically give themselves free reign to tax away what little money we all have left. it really turns my stomach.
I started a fight with my local city government about a fence I had put up. I replaced/repaired an existing fence and they got all bent out of shape because I didnt pay their permit money, I guess. I called them up and wanted to know why they don't go after the unemployed potheads across the street with all the broken down cars in their yard, instead of the poor 20-something working white girl who has been trying to fix her house up. I finally gave up and paid the permit fee.
If you replace something with something else there was already a permit obtained for it like a shed or fence. I went through the same thing when i replaced my shed, they said i needed a permit and i said its a existing structure and i,m just replacing it. Burned them.
This is an example of laws run amok. Here is a guy getting some free fuel, given to him, but it just happens to be red. No taxes have been evaded, since no financial transaction took place. And yet, the burden of proof is on HIM. If he gets pulled over and dipped, and it comes up red, he has committed a crime? Ridiculous.
The point is that red fuel is untaxed fuel and is not meant to be used on the road. How did you figure that no taxes have been evaded? You are NOT supposed to use untaxed fuel on the road because that means that others are paying for your road repair.

Whoa! Back up there. You are confusing several issues at once.
Road tax is for fixing roads. Oil companies don't have ANY say so about that.
I am not sure what you are reading but IIRC, they brought in 404 billion, of which 40 billion is profit. That is 10% any way you cut it. They spent a whole lot more to bring in what they did. Of course the media is relying on morons who cannot do simple arithmetic in percentages.

You're another one that don't get it. It's not the oil companies making the big bucks. Do a little research before you point your finger at them again. I dislike them just as much as you do, but they're not the problem. I do not own a penny of oil company stock, or any stock for that matter, but it's the people that own the oil that are making all of the money. Very simple logic will tell you who to be unhappy with.

Oh, I see your point. The original guy who bought it didn't pay tax on it, either. I think you're right, thanks for pointing that out.
