If you noticed the best lubricity result from that study came from 2% bio added to fuel. That's what I run right from the Kwik Trip pump. Their winter diesel is rated to -30*F right out of the pump. Never have had gelling issues.
So if you can find 2% Bio added to your stations fuel that would be the best bet, plus you don't have the cost of DK.
Wouldn't they have to PROVE that it was dyed diesel rather than ATF?
Or maybe it's the government so they don't have to prove anything?

Yes, they would have to prove it and yes, I would go to court and make them try just because I have been a big F the Feds (or any political authority) kick lately.
FWIW, I use DK in the silver bottle every other fill up. I have heard of and have a buddy that does use the ATF in his Cummins. He said he does it every 30,000 miles along with his fuel filter. He does hot shot deliveries for my company and his rig piles up a lot of miles. So far no trouble for him.
I agree with Pocket on the lube properties of DK, I've used DK grey for the last 60k but awhile back Orezona made a post about an independent study of additives to determine how well they performed. Bio was at the top of the list, Opti-Lube XPD was 2nd, DK was way down the list. I decided to give the Opti-Lube a try, I'm on my 2nd tank of fuel using it, I think it has quieted the engine somewhat.

The guy from Gov that check around here every couple weeks always ask what is in tank other than diesel. they say that they write about 8 tickets per day. They can tell off road from ATF with ease. They are always easy to deal with and have never even had a problem that i never got a tag for my 2001 truck.
Is your friend doing as we are, 1 Gal ATF every 30,000 miles?
The reason I ask, is there are several folks I know of, some driving Dodges, some Powerstrokes, that are doing the same. One of those trucks has a bit over 700.000 miles. None of us had had any problems with either the engines, or the injectors.
My truck has the least miles, at 130,000, but unless/until something is proven that shows this is a bad thing, I'll keep on doing the ATF in fuel.
Am not sure how much but he did tell me every 30,000 miles he does put ATF in it. He does that along with some other regular maintenance that he does. Next time I see him at the shop I will ask him.
I've heard that ATF is old school and that although it is oil and does add lube to your diesel it does have additives in it that weren't designed to burn. I've been using 2 stroke oil which is designed to burn but also add the anti-gel when temps dictate it. That's my 2 cents.

I've been running 2 stroke oil for 6 months now, 16oz. per fill up and have had no problems. Enough or not, I'm not sure but so far no problems, 185k on the meter.
FWIW, The dot can take a sample of fuel and have it tested. I know this because we had a dump truck that ran out of fuel and the only thing to get it back to town was red fuel. We only put about 5 gallons in it, but that was enough to tint the fuel for a long time. We drained it and changed the fuel filter, but there was still a redish tint to it. It got dipped about 2 weeks after the fact and it still had a red tint to it. I simply explained it and they sent the sample in to have it tested, I guess there is some limit on how much dye can be in the fuel. Officer said if it failed the test I would recieve a ticket, but that was 6 months ago and I never heard anything, so I assume it passed. I really dont feel like calling the DOT and checking, might have been filed wrong or something, my luck I would help them find it and I'd end up with a ticket!!
I bought mine directly from Opti-Lube @ Opti-Lube.com, They had the XPD on special for $38.95 for a gallon which included a dispensing pump, I use the pump to fill an empty DK bottle. Shipping was $10.45 so total cost was $49.40.
