btw, the cayenne thing never worked for me. i poured it on the soil and sprayed the leaves. darned things still went for it. *sigh* ended up saying the heck with it and got rid of 'em (the plants)

Ever seen what happens when you shoot one with a paint ball? Its not exactly lethal, unless you pop one in the head. If your not wanting to injure the pest then a trap would be your best bet.
Our neighbor has bird feeders every where that attract the little pest. we had a couple militant squirrels that would chase and bother our beagle, once they started nipping at her i popped em both in the head with my 10/22 and buried them behind the garage. Their little buddies seem to have gotten the message, i haven't seen any of them in my yard for a while.
If you dont want to kill them, maybe try buying one of those air pistols that shoot the plastic bb's and shoot them with the plastic ones. If they get shot enough, they will probably leave your plants alone.
Get a couple of old towels. Roll them tightly lengthwise and put a few rubber bands on them to hold them. Lay them next to the plants you want to protect on the railing. Go to the store and buy a large container of amonia and a spray bottle. Each morning spray the amonia onto the towels thoroughly. We've used this cheap solution for a few years. Works great! A few wiffs and the squirrels are history!

now after i asked the question, the squirrels have not come back, did they read the thread or something? maybe all the talk about shooting them scared them off.

Along the Cayenne pepper route, try Tabasco instead. I've always noticed that to be more offensive to animals than just pepper...keeps the dog out of the trash too.
I used to have an issue with mice too though, and used peppermint oil. The stuff is expensive ($25 for a few ounces) but only a tiny bit on a cotton ball will do the trick. I used to stash the soaked cottonballs all around where I thought they were coming from and I never saw them again. The smell is supposed to be so offensive to small animals that after a week or two of smelling it constantly, they won't bother coming back. You can get some at the pharmacy...I think I got mine at a Rite Aid or something. Change the cotton once a week (or at least re-apply some oil to them).
