No. In my case, the cop could have waited for me to go through (I was already entering the intersection) and then went after the guy. He might have been an extra 200 feet down the road. Instead, he almost casued an accident.
I know cops are human, and sometimes make bad choices, like this guy did.
I don't think your post is off-topic, this is after all a thread about a speeding ticket, nice to have a few LEOs here weigh in. As to having 1 second to make a decision, let me be clear, I am not criticizing the life-or-death decisions, but I am a little disturbed sometimes by the overzealousness when going after minor traffic infractions like I described. Although I will concede, it does not happen a lot.
i agree...and if i remember didnt they pass a law that a cop cant pursue a suspect traveling at certain speeds? im from ohio so i dont know how much truth there is to it but it said something along the lines of to many people where getting killed or injured by police cruisers involved in high speed accidents
Storm, did you go into your "I'm a LEO" speech? Maybe that torqued him off...worked with a lot of military "LEO's" in the past....the real cops get bent about that.

Such a tough call for the LEOs to make. And I am sure that in most cases where there is a crash during a chase, it's the perp that crashes. It just happened recently, not too far from me, in Santa Maria CA, some guy was running from the cops and plowed into some other guy who was just sitting there at a light on the way home from work. The innocent guy died. That's gotta be tough on the LEO involved. I believe the investigation just concluded, and they absolved the LEO of any wrongdoing, but you know it's gotta weigh heavily on him nonetheless.

Not that I'm aware of, and it would be a bad idea because suspects would just shoot for the magic number.
For my department you can call off a pursuit you initiated or your supervisor can call it off if the chase is to dangerous to the public. We also have general orders that cover pursuits. We're a big department, though, and have chopper support, K-9s for tracking, and enough people to make a perimeter. Smaller agencies may not have the luxury of backing off and picking them up again later.
Well it appears that I'll be fine with whatever course is taken. I spoke with my friend who's a Supervisor for the police dept here.. He is in the process of trying to intercept the ticket before it reaches the county clerk. Tho he said if he can't catch it go to court over it. There is a SOP for the department that states in order for an Officer to say he was pacing without using Radar Devices, he is required to be beside the car and with the car for so many feet. Considering I had a Dodge 2500 next to me until I made my turn and saw him in my rearview. He said it was not possible for the cop to pace me. He also said for a fact the distance from the light I was at, to my turn, there's no way my 8000lb truck could have done 0-70. I was in stock mode, my tuner was disabled due to blowing my IC tubes off. Therefore I know for fact I couldnt of done 70.. This thing barely moves in stock with my lift. Basically he feels the officer made a bad judgement call and used the profile of my truck, and the road conditions (wet) to assume judgement that I was speeding. Also here, if someone is pulled over for speeding and the cop advised them they were tracked by radar. The driver has the right to request to see the radar readout and the cop is ordered by the Chief to show it.
I also have a friend who called me yesterday asking me if I got pulled over during the week.. Turns out the cop was on a side road and saw me pass, he pulled out with his lights running. Never once did my radar detector go off (not claiming it to be perfect, but 9 out of 10 times it goes off, even for the new POP gun the departments are using). He said he would go to court as a witness if I needed him.
Like I said before. Georgetown is a rich area. I'm by far not rich, middle class.. There are only 2 cops I know of that are "REAL" cops and treat the law equal to others. My buddy (the Cop Supervisor) said the officer who pulled me over is not a very, nice, cop. He's had situations with him before.
So.. I will know monday if he was able to grab the ticket. If not I'm going to court with my friend who saw the cop, my other friend who's one Austin's most dangerous lawyers.. I'm not worried about this.. Because no matter HOW MUCH power I put down on the pavement in my truck.. I do not race in town. Not where I was at..

That's a department policy, not a law. A lot of departments don't like chasing m/c because it usually just doesn't end well. You can't PIT a m/c or use spike strips without causing a crash, so you're just following until something happens. That something is a collision or lay down a lot of the time.
Storm- Pacing from the side must be something that the individual department does or something your local courts require. That said, there are some badge heavy guys out there and if this fellow is taking liberties with his position it will probably come back to bite him.
That must be some buddy with the police department. He’s willing to put his job on the line for little old you. The sad part is that you would ask a “buddy” to go out on the limb like that. What he’s doing at the very least is violating ethical directives of the police department’s policies, any police department. In most states he would not only be fired for what he’s doing, he would loose his Law Enforcement Officer’s certification for this little ethics violation. Not to mention that any supervisor who would 1) badmouth one of his own officers and say he used bad judgment and was profiling (which is against federal law) on your word alone, is a poor example of a supervisor and 2) any supervisor who would pull a ticket written by another officer is a disgrace to the badge. For your information, it’s called “officer discretion”, that’s why we have courts and judges. So people can argue their case in court to determine who is in the right, rather than have “my friend who's a Supervisor” violate everything he is suppose to stand for in law enforcement. I bet your buddy would be elated to see that you have detailed his plans on the Internet for all to see. Why don’t you just give us his name? He’s standing on the rim of the toilet anyway, that way you can push him and just flush his whole career away. We know what department he works for, if he does this he needs to go anyway, there is a good chance he’ll get caught doing it anyway. All the officer has to do is complain over this guys head.
Storm, why don’t you just take responsibility for your actions? You said in your first post “Supposedly I was doing 70 in 45 but I don't know.. Wasn't watching my gauge..” then you said “Its just really odd to say you paced me doing 70.. But who knows.. Maybe I was..” , but now your innocent. You need to just go to court with the “friend who's one Austin's most dangerous lawyers..”. ooowwwww, and see how it all works out. That’s a win, win for officer anyway. The officer gets paid to be in court, so he makes a little over time and whether you win or loose, if this dangerous lawyer is so good, this little court appearance will cost him thousands of dollars in lost time alone. The officer will appreciate that. Another friend you take advantage of because you won’t take responsibility for your action.

it's like the current issue in upstate NY. the trooper chased the bike approaching 100 mph, by some accounts, and the trooper loses control of the SUV he was driving (great thinking!), hits a tree and dies. They convict the biker of whatever assanine law they came up with because of the death. sounds like they were both to blame to me. The trooper's arrogance got in the way of good judgement.

I said, "WTF! never heard of it"
he gave me a "written warning"

now THAT is asking too much...even if he offered. No way in hell a LEO is going to sit there and defend you IN COURT against another LEO.

Go up to the court, turn it in, they take it off your record. Did that last summer (got the ticket on the last day of school...what a way to end the year).
