I had a job doing concret work,finishing set up and all the rest to.Did this for the last 10 years. Lay off come on in Nov was layed off by them (the bosses)I couldnt sign up untill after the first of the year,cause I had drawn it all out before.Went back in after lay off in person finished up the end of the year things was told again that work was done for the year.After thet they come to my home told me that if I didnt get rid of my family unemployment would be cut off and I wouldnt have job any more.Chose family being this was after lay off did I get fired or did I quit?If any one has any in put on this would sure like to here it thanks.

Are you REALLY saying that someone from your former place of employment (owner, manager, supervisor) PERSONALLY came knocking on your front door, at your own house, and told you to "get rid of my family"? WTF kind of statement is that other than one that would be grounds for legal problems initiated by yourself? Do they want you to divorce your wife and send the kids to an orphanage as a condition of continuing to receive UE checks? Or are you supposed to bump off the family members as a condition of receiving UE?
Sounds like a way of getting you to not take UE, I say let em try that one would go over real big in a hearing (that is if I understand correctly which I am not sure i do) I would absolutly love to be sitting in on that UE hearing when they say that they aren't going to pay unemployment unless you get rid of your family.
BTW once again if I am understanding the post correctly, your wanting to know if you quit thus making you ineligble for unemployment, well if a company says you must choose between the work or family and you quit you can still collect, there are times were you can quit and still collect and this is one of them.

UE is a tax paid as part of your employers obligation to the system. The state usually administers this. Your employer cannot stop your recieving benefits, if you qualify. This may vary from state to state, but as an employer they can contest the payment of benefits and they have to have a good reason and it involves a hearing. I would contact the UE office. If I understand what you are saying. This is my opinion only. Good Luck>
did they say not to claim unemployment or you would not be called back into work? obviously they can't do that but if they have to pay a portion it would explain why. check the labour law. not much you can do though without proof and for what? you have to work for these guys
it's not quitting by the way just cuz they said so. did you get a form when you were laid off? saying how much you worked/earned, reason for leaving? if it says you're laid off then that's how it is. boss can say whatever he wants. they lie all the time. it doesn't mean squat. hang onto your dismissal papers
check your state labour laws again. you've got 10 years but it's seasonal. did u ever work thru the winter on the snow or something? find out what your legal status is as an employee to determine if they have a legal obligation to hire you in spring.
i wouldn't worry about it. just go back to work in spring and if they act mad screw them. if they want to live up to some bogus threats let them try.
its the same thing here. all these ****ty little companies want to cut corners so they can undersell the next guy. the money has to come from somewhere

What I want to know is; who told you to get rid of your family.
Yes the owner of the company came to my home and said to me,if I dont get rid of family UM benifits would be cut off and would not have job any more. He was also drunk. There was a lot more said than just that but the rest is mostly just a drunk with a lot of courage and stupidity.I will not choose job over family. There is more out there than just that job.Employer told UM that I quit coming to work and that he had called several times and I had hung up on him,this did not happen.I think this is there defense to the UM people. The answer to cowboy9mille? is yes to all.
IMO, your next step is to have a talk with someone at the UE office. Any way that you can trip this guy up on the dates might be nice. And in the end, this is not a business that you really want to return to; no need to give him the opportunity to repeat this. I have zero tolerance for liars.
*Any reason why he would want you to get rid of the family? I've heard of employers playing various games in an effort to stop people from collecting UE, but this one is very unusual. UE is often administered as a form of insurance; when an employer has frequent layoffs their required contribution to the state goes up. It's like drivers that get in accidents; the more their insurance is used the more they pay.
I was not aware of what was happening to me right away so when the denial papers came, I didnt know how to answer the questions. They were all for if you had quit your job.And I guess I was the only one that didnt know that I quit my job. I answered some of them wrong and some could not be answered at all.(He just plain does not like family).( I grew up with these a&& Wh)!$.They are the kind of people that have to call the real people out there low life & schum & things like that.I am waiting for the phone hearing with the judge comes in about a week.It seems to me that they are some pretty sneakey bad people.With the ultimadums I was given I may have a good case but they will just lie more and more.
