National news shows a woman complaining about how dangerous atv's are and how her child died on one. She say's "we" should not allow the atv's and we should regulate them more.
My quesition is why then did she allow her child on one?
No one wants to see anyone hurt but what do they expect when they let a child ride one unsupervised? As far as I'm concerned it's her fault, not the manufacturer. Looks like they want to regulate atv's like guns.
I'll agree with both of you....I'm not sure when ATVs became toys for kids instead of what they are--motor vehicles that should not be operated by someone who hasn't at least been educated on how to drive. I don't know how many kids I've seen barrelling down the country roads around here on them. Several have been running almost as fast as the cars! I think everyone's started treating them as overgrown bicycles, and forgotten the things are more like motorcycles, or even cars--except they don't have doors and a roof to protect you when you flip it over.
It's always someone who wants to get money or attention that makes statements such as those. It's as rediculous as the old lady who spilled the hot coffee on her lap at McDonald's, sued them, and won an absurd amount of money, and now their coffee cups have to say "Hot" on them. They don't think about the potential consequences of their actions, and this lady probably wants to get the attention off herself as a parent that let her kid go out on one. There is tons of safety equipment and training available for ATV's, but regardless if the rider doesn't go along with any of it, it's their own fault. It's like suing the maker of a knife because it was too sharp and you cut yourself with it.
I read a story about ATV's and possible goverment regulation last week in my local newspaper. It might have been the same woman whos son was killed because of reckless driving. Anyway, her complaint was that the SALESMAN was at fault because he didn't warn her that the ATV could be dangerous. They are trying to sue now. Gee, when you went into buy your big ol' F350 Lariat CC Dually, did the salesman tell you "Now, this vehicle can be dangerous if operated inan unsafe manner"? I don't think so. When will people accept responsibility for their own action (or lack of). I truly hate to see any child killed on an ATV, but the parents or the guardians need to act like grown-ups, and not let a small child (no matter how experienced they are) on an adult sized machine. Heck for that matter some of the machines out there are probably to big for me. But that is what they are....a machine, not a toy. Heck where I live a lot of people are killed each year on snowmachines because they were doing things they had no business doing. Sorry for the long post, but I really get burned when people want to blame everyone else except themselves when tragidies like this happen. Just my $.02

This statement tells alot about how stupid the woman is. Anything with four wheels and a motor is dangerous, you shouldn't have to be warned, it is just common sense to know that.
Everything we do could be dangerous if we are careless, people should just start owning up to their mistates and stop trying to find someone else to blame. I have been careless and done many things that I could find someone to sue for, but instead I feel stupid and say "man I should watch where I am going."
i agree it's the rider not the machine. just that the riders get carried away way to much.
i have 3 adults very near me. the hot shot type. last eve one was showing off with out a helmit out on the street. wheelied it right into a parked camper trailer on a side lawn and had to be air lifted out. wife said he lost his leg in surgery last night.plus the police say his b.a.l. was .15 well over the limit of .08.

I feel for the parents, it's a terrible thing to lose a child and you and you want to lash out and blame anyone that can...other than yourself, of course.
But so many people think that they can just hop on the Gravy Train with some stupid lawsuit, and save us all from ourselves. We're already becoming so over-regulated that it won't be long till it's illegal to go to the bathroom; all sorts of dangers await us in there! Wait! When I was four I slipped in the bathtub and split my chin open, I think I'll sue someone...now, lessee, who might be liable? The bathtub manufacturer for one, those darn things are way too slippery. Also the soap companies, that had to be a contributing factor, and oh yes! I've got to name God in my suit, 'cause He made the water and that was a major contributor as well! Statute of Limitations? We don't need no stinkin' Staute of Limitations! I can sue for something that happened 40 years ago!

I grew up riding a 4wheeler, started when I was 5. You can sure learn a lot from driving one, and compared to today's 4wheelers it was small. 2wheel drive with a 225cc engine. I rolled it a couple of times, but I learned from my mistakes, didn't blame others.
I think today's society lacks immensly in common sense. Nobody can think for themselves, they have to be told what to do, or what not to do. That thing with the old lady and mcdonalds is just asinine. She would have been complaining if her coffee wasn't hot. But since it was, and she was clumsy when trying to drive and drink it at the same time and spilled it on herself, why should she be rewarded for her stupidity???
I feel for the family that lost the kid, but going after atv manufacturers won't bring him back and all the money in the world won't make them feel any better.
When will people get a clue??

I did not mean any disrespect by calling the woman stupid. I feel sorry for her, I can't imagine what it must be like to loose a child. But everyone is just too "sue happy" these days, they want to find someone else to blame for their mistakes.
No, you're right, she IS stupid, and has proven it! She just needs to realize that she and whomever else allowed that child on that thing carry the greatest part of the blame. I'm just saying that I can sympathize with all the family members affected by their loss...but some of them are still to blame for that loss and just need to get a clue! -TD
When you buy a ATV you get bunch of literature talking about riders under 16 must take a rider's safty course before attempting to operate the ATV.
How old was this child?
Did this child take the required safty courses by law to operate this equipment?
It is the parents responsibility to make sure their child complies with the law. It isn't my fault or the ATV's that she didn't know or care. If that lawsuit goes through, then I'm going to sue my neighbor just for the fact that she is ugly.
ATVs arent dangerous. Its the OPERATOR that who rides beyond his/her own abilities that makes it dangerous.
Ive been around snowmobiles, ATVs, motorcycles, PWCs and boats all my life. I have never once gotten hurt on anything. The reason for this is because I was taught to only ride as fast as I feel comfortable. I can ride at 80 mph all day long on my snowmobile. However, Ive been riding snowmobiles for 13 years, so I know what Im doing on one. Ive been an ATV owner for 8 years now. I can trail ride my Polaris Sportsman at 40 mph all day long and not ride beyond my limits. I know the trails I ride on and I know what the limits of both myself and my machine are.
You cant regulate stupidity. However, people often are unwilling to see that they are at fault so they feel the need to blame the manufacturer. Its the same with Ford's Wilderness AT recall and all the lawsuits aganst gunmakers.
You could pose the question of what kind of mother lets her kid ride a 700cc ATV? Im 25 years old, 5'11" tall and 180 pounds with lots of riding experience and a 700 is a lot of machine even for me.
