PCaraway, you did all right man! Good for you.

When a contract is offered and accepted it's in force. The contract writer (dealership) has a legal duty to make the contract valid. Ambiguous terms are resolved in favor of the other party (the one that didn't write the contract, which would be you). I think you had a good case to stand pat on this instead of re-structuring the note.

Also, remember that Ford Motor Company, Ford Motor Credit, and every dealership are independent entities. FMCC wants your payment, and that's it. They don't care about your "deal." FMC sold a truck to the dealership, so they're OK. The dealership screwed up with you and has to remedy the situation between themselves and you.

I question the wrong VIN thing. If the VIN they ran to FMCC were different from the one on your contract, that's fraud on the dealership part with FMCC. If the VIN on the FMCC papers and your papers is an F-150, what about your title, registration, and tags? Either way, this can get ugly, and to save face, the dealership should eat the difference as they did.

It's kinda fun being in the drivers seat every now and then, isn't it?

Congrats on the good outcome! Free oil changes on the 6.0PSD is a big deal, too. Those are pricey.

I work at a dealership, have for many years. Sold Fords for awhile then went back into the service dept. Where I belong .

You would be amazed at how many times the loser salesmen deliver the wrong vehicle. They get so excited about making a sale they just up and deliver the first "silver one" (most popular color currently) that comes off the wash rack. What a mess, calling the police because a car is missing, or calling 2 or 3 people back because they don't have the car they contracted for. Imagine how it could have been if you were buying an F150 and they wrote the contract for the VIN of a nice 250 PSD, I would be back yelling that I want my diesel truck!!!

Oh well you seemed to have been blessed, nice truck and free service to boot.

Thank you for the added input. Very interesting -- how we all continue to learn from the various sources of information....

It seems clear the burden is on them and they are trying ot get you to "agree" to the change and push it through. To not get a lawyer involved woould be a risk.
