never a dull moment

so we are partying last night and two of my very good friends are boxing, bareknuckle but they are friends so it was just for excitement i guess, not for blood, just goofing around

well, unfortunantly one of the times brian fell over, he hit his head. knocked out instantly, very large cut on the rear of his head, bleeding badly. we call 911 ASAP. cops arive, my friend got there before them ( hes a fire fighter, trained for EMT also )

they want to charge my friend he was boxing with 2nd degree assault?!?!? it wasnt a fight, its like two budies just wrestling and one just happened to get hurt... so i distracted the cops so my friend could exit the property, its unfair to him to get charged for assault when they were just goofing around isnt it?

well, the cops didnt like the "distraction" cause they were trying to be heros and arrest jake, so they start manhandling me and taking me to the cop car, ( keep in mind, i was drinking but not beyond to where i didnt know what was going on ) so, since one was being a real jerk, hes bent over behind me searching my pockets and socks....with his face right up to my rear end- my last act of defiance was to let out a silent; but deadly fart. oh yeah... i ate spaghetti yesterday and these farts were the type to make your eyes water. i figured, im already going to detox, might as well get a good laugh out of it. but, they let me go without detox, so we went to the hospital to visit my friend.

we were very scared for brian, he hit his head hard. but we got to the hospital and he was sort of making jokes about it, he knew he was mostly to blame for boxing while intoxicated ( BWI ) anyways he got a few staples to the back of the head and a stiff neck. we just visited him a hour ago, and hes doing pretty good.

does anyone know if the cops can actually charge Jake with assault, when that clearly wasnt the case? can brian contact the cops and have those charges dropped?

Was it private or public property?

Public property yes they can, private property then your buddy Jake has to say that he wants to press charges before they can.

You are just lucky they didn`t give you an emmisions ticket!
Or assaulting an officer with (tear)gas

You're right BuiltTough....NEVER a dull moment. You need to move up here to Canada where all we do is have snowball fights and run away from polar bears. We also have ice fishing and play hide and go seek with Eskimoes.....

i doubt anything will ever come of it plus if it did go to trial your friend who got hurt could explain o the judge or jury and would never be found guilty... this sounds like a bad verse of " Alices Restaurant " lol

First and foremost, the COPS can do anything they want to. They can charge you with anything they want to, they can apprehend, process and even throw you in jail, a whole 24 hours of your life that you'll never get back. That's one of the first lessons every new attorney should know. Now whether or not the charegs stick or not is something altogether different. Like mentioned before, would your friend be convicted, probably not. The point is, cooperating is the best thing that you can do in any given situation.

Well, as an ex-cop I can tell you that simply isn't so. At least in most states. Now, I'm sure there are some small towns where the cop is judge, jury, and executioner.

In the major states and metropolis's a bad arrest can get you in a "heap o' trouble, boy!"

well the most important thing is Brian is ok, despite being banged up pretty good... we feared the worst, brain damage, coma, paralized, and there wasnt much we could do but hope... so Jake getting charged with assault was the least of our worries but it wouldnt help the situation.

Matt- youre a funny guy! when does Lil' Red part 2 happen?

I seen both parts
As for the boxing in a house, i dont think they can charge anyone w/ anything.
