The only thing in question is Bigger Better when it comes to air compressors. You gal dang right Bigger is Better.

It is good that somebody has filed suit. Unfortunately it does not cover older compressors that were sold with fake HP ratings. It also does not cover the 220V compressors which have been labeled with fake HP ratings. It will be interesting to see if all of the places like Northern Tool, Harbor Freight, Cummins, etc etc relabel their compressors.

I can see the posts now that will come in 6 months: "WOW! What a deal! I can buy a 5HP compressor from XYZ China company for 1/4 the price of a..." -You get the situation

There are several threads here that cover the differences in the HP ratings that manufacturers have been using. If people only read the G&W forum and used the search function...

Question

Question. I read those threads some time ago and "sorta got it". But, if the compressor (home owner type) meets the the 40 psi and 90 psi CFM, then what's the problem?

Many times those ratings are just as fake as the HP ratings. They are "calculated" ratings based on displacement and theoretical rpm's at 100% volumetric efficiency with no temperature compensation.

I just had to dig up this old thread to tell you guys about the letter I got in the mail today.


Dear Claimant:

You have been deemed eligible to recieve an award under the DeVilbiss Air Compressor Settlement for the claim you made through the toll-free telephone number or settlement website. Below you will find a list of DeVilbiss product packages available as an award under the DiVilbiss Settlement. Please select one product package by checking one of the boxes below, and send this notification letter to DiVilbiss in the enclosed addressed, postage paid envelope. Do not return this letter to the Claims Administrator at the address above. DeVilbisswill ship the product free of charge. In order to recieve your selection, your response must be recieved no later than February 4, 2005.

The product packages available as an award under the DiVilbiss Settlement are the following:
  • 3/8 inch air ratchet + Blowgun
  • 3/8 inch 25 foot rubber hose + Tire inflator/with gauge + Roll Teflon Tape.
  • Mini rotary air tool + 3/8 inch 25 foot rubber hose + blowgun.
  • 2 - 3/8 inch 25 foot rubber air hose (50 foot total) + Roll Teflon Tape.
  • Paint Spray Gun + 8 peice metric/standard deep socket impact set + Roll Teflon Tape.

Before you collect a few dollars worth of gee-gaws to throw in the back of your tool chest, you might ponder on the following:

1) Were you really deceived by the "peak horsepower" label?

2) Do you think JoDee Favre (the class attorney) even knows which end of an air compressor is the sharp one?

3) Do you think she and her partner really deserve the $5 million dollars in legal fees they asked for in this case?

4) How does this compare to the value of the "teflon tape" given to the supposedly injured class members?

5) Do you really want to encourage the Association of Trial Lawyers of America?

6) Do you really want to encourage places like St. Clair and Madison County Illinois to create venues which are highly favorable to attorneys specializing in class action lawsuits?

7) Could part of the reason that American jobs and American manufacturing are moving to China be to escape the reach of the American legal system?

I think most members of this forum know perfectly well how to evaluate the capability of an air compressor, and this is one of those frivolous bits of litigation that hurt the industry and benefit no one but the attorneys bringing the case.

When i bought mine i saw the amps and knew it was a 3hp not a 7. My mini die grinder and hose is on its way.

When I bought my Craftsman, it was big enough for the house. My 50' of hose is on it's way. Now I can inflate the air matress inside the tent in the back yard instead of in the garage and then having to wrestle it into the tent.

If they hung an Attorney a day in the town square we woud have fewer frivolus lawsuits.

Get over it comes to mind.

So instead of putting the burden on the industry to make products that live up to their specifications, we are supposed to put the burden on the consumer to know that the manufacturers are lying when they advertise horsepower and CFM capacity of an air compressor? And we disparage lawyers for calling the industry on the carpet for their lies? That sounds logical enough. I want to be your salesman. I'll sell you a product that I have lied and been deceptive about, and then expect you to realize that I'm lying when I'm selling it. Oh, and in answer to your questions:
1. I'm betting a lot of consumers were...they got a product that did not perform as it was advertised. Not everyone is the super-consumer that you are. Some of us expect manufacturers to be honest in their claims.
2. I'm betting she knows far more about air compressors at this point in her life than you ever will.
3. Do you have any idea how much time was put into the suit by her, her partners, their support staff, etc.? How 'bout the amount of their expenses?
4. You're completely ignoring the value of the other items being given...and I'd hazard a guess that, in the aggregate, the injured class members are recovering FAR MORE than the attorneys.
5. What relationship is there between this suit and ATLA? And better yet, why don't you want to encourage ATLA? We want to encourage manufacturers to lie about their products and get away with it?
6. How is this encouraging a "place"? Do you think the jurors of that county are colluding with the attorneys?
7. I hate to break it to you, but moving to China doesn't escape the reach of the American legal system. We can sue someone in China who sells their products here, just as easily as we could if they lived next door. And no, I'd say there is no correlation between the legal system and industry moving out of the country. The reason is CHEAP LABOR. Moving to China doesn't spare a company any legal liability, except that which it has to its employees. I suppose you'd be fine with screwing the employees too?

Talking The Tool Fairy left 2 new air hoses on my door step!

I love seeing the UPS truck when I haven't ordered anything. I received my 2 25' air hoses from DevBliss today.
