Price protection question, again...

Hi all. I will preface by saying I am fully aware the issue of price protection I am presenting has been discussed several times already in this forum. But, I thought I might put my question to the "Super Duty Court" and get the jury's response? So here goes. I am expecting my 2022 F250, 7.3, XLT Premium, Carbonized Gray, E locker, upfitter, Fx4 to come rolling into town in the next week or so (yeah). In reviewing the window sticker, the December 7, 2022 price increase of $1,295 was included, so I contacted the sales guy and the dealership has been "digesting" the issue of reducing the MSRP by the $1,295, for two days, without getting back to me. I shared with him that I was aware of the December 3, 2021 Ford directive of price protection (my purchase date is November 29,2021). My reason for discussing this with the dealership was so that this would not be an issue when I sit down to cut them a check. Now, my question to y'all: I expect the dealership to do the honorable thing, but if not, it would seem to me that the evidence of the Ford directive and that dealerships do have a process to be reimbursed by Ford in such cases, would be compelling evidence in small claims court for recovery of the price increase. Has anybody pursued such a claim? BTW, I am not overly litigious, but I signed the original order and the price was on the document. Thoughts?

Carefully read any fine print in your order document. I don't know what standing an "order" document has as a contractual sales document. A sales contract typically has lots of fine print on the back including a clause that any disputes be handled in arbitration not the courts. An order document may only mean the dealer agrees to order the truck at the price shown on the document. It does not necessarily mean the dealer agrees to "sell" you the truck for that price if the price changes. I agree this is splitting hairs but if you are talking court action, details matter.

I wonder how you would bring this case to court. You have not completed the sale. You can walk away if you are not agreeable to the final price. Assuming no deposit or a fully refundable deposit, I don't know what legal standing you have to force the dealer to honor the order price.

These are just my thoughts. I'm not a lawyer. I hope your dealer does the right thing.

I picked up my '22 last week that I ordered last March and I'm going through this as well. my dealer made me pay the new invoice price and they're supposed to send me the price protection refund when Ford sends it to them. they say Ford is slow in paying and they're not funding the difference.

So that's fine but what if they don't ? will Ford do anything about it ? I expect I'm going to find out given another dispute I'm having with the dealer. but in my case and it may be in yours as well it's either pay it and hope to get it back or not get the pickup. that was the option I was given .

So I talked to Ford and they said the selling dealer will receive the price protection refund withing 45 days of declaring the original customer took delivery of the vehicle. so the dealer charging the full price and later refunding the PP is an acceptable practice under Fords policies.

Sounds inconvenient but as long as there is a plan its something I could live with.

What my dealership told me on price protection:
"The price protection can get confusing. The super duty price protection is on the base price but it won't apply with xplan pricing. The way Ford protects the price is through a rebate they give the dealer. When we report the vehicle through XPlan that negates any price protection. So we will have to wait and see which way is better for you. We will look at price protection versus xplan pricing to determine which is the best way to go."

I'm not going to worry about it at this time. Xplan does include price protection in its fine print, so when the time comes I'll bring that up.

I ordered and purchased using Xplan and my dealer didn't automatically give me price protection, but when I informed them that I knew they would get reimbursed by Ford and quoted the process they redid my paperwork to provide protection from the $250.00 price increase between June and November.

I am going through the exact same thing with my dealer although they seemed completely unaware of PP. He did tell me he looked into later in the week and he told me the same thing about 45 days but he was under the impression that it would come straight to me which I highly doubt. Would love to hear if you get any progress regarding the matter. Also, from his research he did not have to submit anything for the PP and that it was automatic. Any info on this? Thanks and good luck.

Ford confirmed it would come to the dealer. I expect to have to fight for it.

Every time I’ve bought a vehicle the dealer filled out a “We Owe” form and gave me a copy. That’s a legal document showing everything pending in the deal. If my dealer agreed to send me price difference of price protection at some later time I would insist it was listed on the “We Owe” form. If there was mother pending the form would state that also.

Not sure if its different being that I am in Canada, but I took delivery with 2 price adjustments since my order date. The price on my final contract was the exact same number I signed on 7 months previous. Price protection or changes never even came up.

I may be different then because the invoice and the window sticker include the price change. which actually makes sense because if the original customer doesn't take delivery then that vehicle would have a discount Ford doesn't want to give.

.

Picked up the 2022 Lariat F-350 today. They had to call Ford to get the assurance that they'd get reimbursed for selling the truck at the agreed 11/15/21 price. So it took some doing and be sure you save - and take - every scrap of paperwork with you to pick up the vehicle.

There was no point in taking anything but a check. I could either pay them the new invoice price and wait for the refund or I could get lost. they'd rather I told them to shove it they's sell it for more money the next day.

I have very little confidence Ford is going to help me should they refuse to reimburse me. but once again if I refused to buy this one I'd be on the hook for the price increase on the new one anyway. so there's a chance I'll get it back and that's as good as it's going to get. these are the times we live in, and it sucks.
