Surging when cold

Surging when cold
Has anyone experienced "surging" when accelerating with the engine still cold? The Dealer can't figure out what is causing this problem. He thinks it might have something to do with the EGR valve.

Yes I have the latest flash and the engine will surge when it is cold I noticed it more when I ran it with the exaust off you can actually hear it surging sounds terrible Ive actually been stopped at a light and had the engine rev up and almost pull me into the car in front of me felt like someone hit me in the rear end had to jam the brake as hard as I could to keep from hitting the car in front, so far this has only happened 3 times usualy after work when I dont let it warm up for a few minutes.
