Got a 3 day notice to pay rent or quit today. So I may or may not be on much after this weekend. Don't exactly know what is going to happen. Contacted my VA rep and we are going to do our own paper filing. HUD called me this morning and told me they will not renew my section 8 for this apartment because of the bed bug issue. So naturally the management company wants me out as quick as possible, with all back monies paid up in 3 days. I don't have $1,197 and even if I did I wouldn't give it to them, I would use it to get into a new place. I was told by Cristi of the management company, when HUD first cancelled "not to worry about it" when I told her I cannot pay the full rent without HUD support. Now, that they know I will not be here for another 12 months, they want me out in 3 days. Good luck with that. Anyway, the VA rep will be here sometime tomorrow to have me sign some papers, and we will see what happens after that. I have no problems moving from this place, but in 3 days is not going to happen unless the Lord steps in and does some miracle of some kind.
Bed bugs are a health hazard. So they will not renew the contract. And because I have been here two months only paying half the rent waiting for the pest control people to spray, I now owe them money. Although I dispute the amount they are saying I owe, I know I owe them money. And, knowing that HUD will not accept this unit, I have no choice but to move. I did not know I would only have 3 days though. I don't want an eviction on my record, so that is one reason to fight it. But in the end, I cannot stay here as I cannot afford to pay the full rent.

Jim, you will only have a legal record of eviction if they have to go to court, win a judgement against you, and then have the sheriff's department civil division serve you with removal orders and physically remove you from the premises. That whole process can take 4 to 9 months, depending on how quickly the courts move in your area.
Basically what I'm saying is, they can not legally lock you out from your apartment, nor can they mess with your plumbing or electrical in order to try and make you move quicker. You will probably have a new apartment before they even have a court date set.
One thing you have to do is make sure your don't have any bugs in any furniture or clothes you take with you or you'll have the exact same problem.
There would be no way I would be able to get a different apartment in the same complex. There are only 16 units here, and I think they are all full. Besides, I really don't want to deal with Fox Property Management anymore after this.
Stewart, that is my biggest fear is taking the damn bugs with me. I am going to have to check everything carefully.

I'm with Stewart on this , they can't legally evict , your a Vet with rights , if you don't believe me go talk to an Attorney pro bono , don't let these fools run you around Jim, most people would walk in your case you have a ligament claim.

The place he's in has every legal right to start the eviction process because they haven't been paid the full rent. Not even being a vet allows someone to live in an apartment without compensation to the owner of the apartment.

I should refraise My comment , they can but being a vet the legal status is 90 day eviction not 30 day , I sent Jim the California eviction link the last time , he needs an Attorney to handle this , other wise he'll get the run around and or the homeless status.
Okay, the plan, for now, is to get into transitional housing. If that happens today, I will be out today. I know it takes some time to evict someone, but I really don't want to go through the process. If the VA can get me into temp housing today, I will rent a U-Haul and storage unit, and move out as quickly as possible.
On top of everything else, my government phone has been shut off because "I do not qualify" according to Safelink Wireless. Nothing has changed, and I am still eligible for California Lifeline so I have no clue why the morons at Safelink have pulled the plug again. I called them yesterday when I found out (from a friend who tried calling) and of course, California lifeline is not open on the weekend. SO I will have to try and get that done tomorrow as well as go to HUD and get new paperwork, and then call Perry (The VA rep) and see if it will be possible to move out. Going to be a busy Monday.
BTW, I understand Fox's position on this, I am just a little upset that they did not give me until the end of the month to move, since they want the full rent for this month too.
