4r70w question

i have a 2000 4r70w that would act like it shifted into neutral when it was supposed to shift into 3rd. I was given a lower mileage 97 4r70w trans and read that i would need to change all the electronic internals over so i did that and when i took the valve body off the old trans i noticed the retainer was bent up on the 2-3 accumulator piston so i pulled it out and the spring was broken into pieces and the piston had a tear in the rubber on the bigger ring. i assumed this was the reason that i no longer had drive or over drive and proceeded to put the 97 trans into my vehicle. It went in bolted up and everything plugged in like it should and low and behold it does the same exact thing. It revs out to almost 3200 rpms before it attempts to shift into 3rd and just winds out like it hits neutral until i push the od off button to lock it into second. I did take the retainer out of the new trans to check the spring and noticed it just sits on top of the spring and nothing holds it in. Is this right or is the retainer supposed to lock in someway?

There should be a ridge for the clip to set in.
