Date set again

Got the letter from the court for the date for small claims court last week, it is now set for May 20th.

I was trying to figure out how I was going to show the court the sequence of events with out it being my word against his. Looking at the evidence he has submitted to the court it gives me a paper trail to prove some of my points. His receipts for parts show that the oil cooler was not replaced until well after the internal EGR coolant leak repair and after the head gasket head stud repair. This should have been replaced during the EGR repair as this is part of that repair procedure as well as a request by be before the first repair was started as I had discussed this with the shop before they started. Hopefully the Judge will understand what the repair procedure is from what I have submitted, which is the Ford TSB 09-08-03 as well as other articles on EGR repairs and head gasket repairs.

By the time I had figured out that the shop had fubar'd the first repair they had already completed the first head gasket head stud repair it was too late. I had to give them a chance to make good on their warranty repair as that is what is spelled out in the repair/work-order contract. It was not until after I had him sign the Agreement to Repair was I legally able to bring my vehicle to another shop to have repairs done that he will have to pay for.

Latest repair

I have been taking my truck into the Ford dealership to have all the repairs done after the first shop screwed it up mostly to document the repairs so it would not just be a my word against his thing.

As I said earlier in this post the oil cooler gaskets were leaking, so I had the truck into the Ford dealer to make the necessary repairs.

During this repair the mechanic found that the intake gaskets were installed incorrectly. The gasket installed on the wrong sides so the positioning tab was out of alinement and these issues caused an intake leak. See number 1 on the below attachment.

He also found a Dirt track into the intake from this so it was sucking in some dirt. Wonder how much just this has shortened the life of the motor.

I've installed a couple studs,,, lol,,, and NEVER had one "break".

He was not using ARP head studs as we had originally agreed, he went on the cheep and bought some cheep Chinese ones off of EBAY. He did this 3 times before he finally put in the ARP,s after I got him to sign the Agreement to Repair.

What is the definition of insanity.....doing the same thing over and over and expecting a different result.

Had our court date in June the judge still has not made a ruling yet. The court clerk said judges have up to 6 months to make a ruling.... so half way there will post the outcome when a ruling comes out.

Hated to have to resort to going to court but hate being ripped off more. Especially when the shop owner says I am sorry for all the **** and Ill give you all of your money back and does not follow through on that promise. But I did record that conversation and others and was able to use them in court as evidence. The shop owner even admitted that the recordings where conversations we had.
