The chances getting stopped here are slim in CO, now if you have any trailer DOT regularly pulls trucks over for inspection... our fine is 1,000 a gallon up to 30 gallons. Now they don't care if you have a 30 gallon tank with 1 gallon of fuel...its still 30k fine, a 12 gallon tank with 2 gallons of fuel is a 12k fine...its capacity, not what volume remains in it. Here its also considered tax evasion...so that creates an entire **** storm of legal stuff too.... many other states as well....
Worth the risk??? not by any means... fill up a couple storage tanks over the winter if you can...they pay themselves off quickly if you drive a lot. I fill 1000 gallons worth when diesel gets down to 3.50 during the winter... that's a min of $700-900 saved a year and its at my house... kinda nice... hell we are the cheap people who go buy 250$ worth of shell gift cards at King Soopers, and then get 1.00 off a gallon and use that for a max of a 50 gallon fill up... adds up... 1000-1500 saved on fuel a year is well worth the effort to me... but red diesel is not worth the risk by any means... I miss the days that it was legal to run it in a farm truck..... On or off road..
