If I'm not mistaken, in some states you can reconcile this on your state income tax return. Just like how they expect you to report out-of-state purchases and pay the sales tax on them, you can also claim that a certain amount of the road-taxed fuel you used was used off-road. 'Course, you'd better have it well-documented, and such an entry might be a red (no pun intended....) flag for audit.
well what about dual purpose plates? so you leagally onlly used off road fuel on the job and then put taxed diesel in it and when over the road.
what can they do about that if ur filter is red?

I remember reading about a guy with a diesel Excursion that he always ran 15% diesel and the rest was used/filtered ATF... ran it all the time. There must be some way around that if he got dipped.

if the vehicle is registered for on road use, it must use clear taxed fuel.
our dump trucks see almost as much off road use as they do on road.
but it is registered for driving on the road. so it gets clear fuel. if there is red fuel in the system, it is a big fine. even if it is driving through a job site covered with mud.
all the tax cops care about is that it is registered as an on road vehicle.

he probably carries a tax receipt for the declared amount of fuel bio used.

Yes i remember reading that in diesel power a couple years ago. He kept 5 gallon jugs with him iirc.
This thread is going every which away. I think, if you get pulled over for a check, its up to the guy who pulled you over. Its his call, if he is a nice guy or a jerk. Same as a speeding ticket. Some will give you a warning, some will give you a ticket. Its all boils down to, are you willing to take a chance? I'm not, I've been tempted in my travels but will not expose myself to a huge fine, to many camera's everywhere. As far as the ATF, who's going to test it and are you willing to go to court to prove its ATF?
