brand new ignition switch too. so wiring between must be failing somewhere. any idea which wire it is on the solenoid that tells it to shut off?
There isnt one that tells it to shut off, just one that activates it. If you look at the solenoid, you'll see a smaller wire that attaches to the switch. When that gets energized, the switch connects the two larger gauge wires and sends power to the starter. For some reason, that wire is energized all the time. Are you sure everything is hooked up correctly?

could be i guess but it had worked at first. then i did a bunch of work on the motor and now its being sketchy. is there a ground wire or something that shuts of the IS that I should check?

replaced mine just for good measure .... dam thing stuck on at a gas station. it was also shorted across the 's' and 'i' so it left relays on and killed my brand new battery.... bad out of the box, so dont rule that out.
unhook your starter cable, the one that goes from the solenoid to the starter, and then hook up your battery.
start chasing wires with your volt meter. 12volts on the wire that comes from the ignition switch says the problem is upstream of that.
12 volts across the solenoid with the wire from the igntion switch disconnected tells you the solenoid is bad.

The ignition switch sends power to the small #5 wire (should be labeled S on the solenoid) when told to engage the starter motor, at which time the solenoid connects #3 and #6.
Remove that #5 wire from the solenoid and connect the battery; if the starter begins to turn, the solenoid is stuck inside so beat on it with a hammer to try to un-stick it and/or replace it (Chinese-made variants are known for being bad out of the box).
If the starter DOESN'T begin to turn, hook up the battery; attach that small #5 wire; if the starter begins to turn by connecting that #5 wire, you have an ignition switch or wiring problem.
The solenoid grounds through its body to the fender.
