I don't want the money back I just don't want him to pull some other stunt and drop if off in my driveway. I already bought a cheap truck with that money and I don't have anything at all to give him if he was to try to bring it back.
hey superduty outlaw, sorry to hear about your situation. i would of gone to the shop to verify the problem and see for myself. how does the mechanic know what the issue is? did he drive the tow truck himself and dissamble the truck on the side of the road to verify the condition?
if it was a correct diagnosis, then i would have insisited on his refund and the truck returned to me.
if he insisited on the money then i would of told him i was going to consult a lawyer before we proceeded.
I believe in the "AS IS" clause. The vehicle in question is a ~25 year old truck, and no dealer would stand behind it, especially for $1500 selling price. Had that guy bought it from a used car lot, they wouldn't have refunded any money at all. They *may* have had their local auto-patcher repair the engine, if it *actually* needed a timing chain, but you can bet it would have been the cheapest parts available, and only the stuff that was 100% required would have been replaced.....
It's little stuff like this that makes me have a strict policy against selling a vehicle to anyone I know. Even if they get 3-5 years of trouble-free service from it, the first time something goes wrong they'll be calling to make life miserable......
Anytime I sell a vehicle I have the buyer sign a paper that says, As Is, Where Is, No Warranty or Guarantee and also that once that paper is signed he takes full responsibility for said vehicle as to repairs, insurance, etc.
Mt grandson sold his 92, Talon AWD Turbo and the fans didn't work. The buyer was told the fans didn't work and he should truck the car to his home 150 mi. away. He told us he would wire the fans on and drive it. When he was ready to leave, I offered wire so he could wire the fans. He declined and said he would drive it home that way.
About three hours later he called and told us it overheated and blew the motor.He threatened to sue us until I reminded him of the paper and the fact I told him not to drive it before repairing it. We never heard another word from him.
