tax question

I know this is off topic, but I'm getting no help from H&R Block. They want 19.95 to answer a single tax question on the phone. I tried to circumvent that by registering online and asking my question online, and surprisingly that isn't working either.

Here it is. I'm in the military stationed in Virginia and my home of record as far as my LES goes is Alabama. Should I file a non-resident in my Alabama state return? I normally only file an Alabama state return along with Federal and now (first year using H&R Block, normally use Turbotax) the software is wanting me to also file a Virginia return.

Personally I think it is kinda silly to pay your home state 5% of your income just because you joined the military there. Makes me wish I was from a state like Texas or Florida with no state income tax.

I'm no expert but it is a state income tax and your stationed elswhere and paid by the federal government, nothing against 'Bama but I dont think they have any right to that 5%. But then we could say that for a lot of taxes now-a-days am I right fellas

Yup, you file under your home state, not where you are stationed. I had been stationed all over the place, and filed where under my home state.

Now, beinng military, and if you want anymore specific answers, you havent visited your Finance Office? You should have one with your unit, and atleast the duty station (post or base). They will be able to give state tax specific answers when filing, and its free of service. If you have any adjustments regarding family or deductions by order, visit your JAG office.

File a resident income tax for your state of residency (based on your drivers license and where you are registered to vote). If that is Alabama then file that one a resident. Virginia as non resident.

These guys are right. File according to what your LES says for your home of record. You can change that though. Get a drivers license in the one you're actually living in if you like it there and file whatever paperwork you need to get your home of record changed on your LES. That will stop the withholdings if you have any. It's easy for us. I wish I wasn't retired.

I never had to file anything in the state I was stationed in. Or the country. Just Tn which I kept as my home of record. I doubt that law changed but who knows now.
