Exhaust Ticket

Yesterday coming home from work I was stopped for too loud exhaust. I got a ticket for inadequate muffler. I have the same exhaust from this thread.

I was driving normal not doing anything stupid. Just think the cop was fishing since it was a little after midnight.


Anybody know what the laws are for Western New York area. Town of Evans to be exact?


What kind of fine am I looking at?

Well, if you read the NY law, you're screwed:

Section 375. Equipment.

Subsection 31. Mufflers and exhaust systems. Prevention of noise.
Every motor vehicle, operated or driven upon the highways of the state, shall at all times be equipped with an adequate muffler and exhaust system in constant operation and properly maintained to prevent any excessive or unusual noise and no such muffler or exhaust system shall be equipped with a cut-out, bypass, or similar device.

No person shall modify the muffler or exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor or exhaust system of such vehicle above that emitted by the muffler or exhaust system originally installed on the vehicle and such original muffler and exhaust system shall comply with all the requirements of this section.

A muffler is a device consisting of a series of chambers or baffle plates, or other mechanical design for the purpose of receiving exhaust gas from an internal combustion engine, and effective in reducing noise.

An exhaust system is a series of mechanical devices for the purpose of receiving exhaust gas from an internal combustion engine and expelling it into the atmosphere.

I am assuming that you purchased the muffler from a local auto parts store. In your area they should not even offer such things. Where I live the local parts stores carry the Cherrybomb line, including glasspacks which are not considered legal here.

What they might consider legal can vary, but many people do not realize how loud their exhaust systems really are. So you might have thought your system was ok sounding, but to people that are behind you it would be obvious that your system is louder than it should be.

My guess is that you might just be able to pay the ticket and be done with it, but they will probably try to enforce the noise ordinance, in which case you will need a quieter muffler. Myself, I use and recommend Wickedflow. It will produce that deep sound that we all love, but should be mellow enough for NY.

The cop was fishing or just felt like being a *****. Theres a lot of people in NY violating their exhaust regulations, I've seen quite a few over the years when I'm passing through.

If a straight piped harley don't get a ticket for sound, no way 99.9% of the vehicles on the road should get a ticket for too loud of an exhaust.
