Cat Converter Question?

Cat Converter Question?

So here I am in the **** run state of California.... I just bought a used work truck it runs well has a new alternator spark plugs battery ect..... Needless to say I take it to the smog and it fails because of emitions testing in this state where the nice Asian guy informs me that its 90% the catalytic converters fault....

so in loo my question!

I need a CA Legal CAT Converter for a 1991 F250 super cab and for the death of me cannot find one any help would be much appreciated.

In California, the seller is responsible for either providing a smog certificate, or for paying for the repairs to get the vehicle to pass smog. If he refuses, you can take him to small claims court and win 100% of the time. The law is very clear, it's completely the seller's responsibility.

Where are you in CA? I would suggest taking it to an exhaust shop unless you want to mess with installing it yourself. I know a very good exhaust shop in the bay area that does honest work.

I did not mean to offend with my "**** comment" just mad at the situation I am in Orange County so finding a muffler shop should not be hard.... that is very interesting....

Follow Up

I have payed him in full for the truck already I have the title and everything. I looked it up and your right he is 100% responsible for making it pass smog...

Should I A)ask him to pay for the repairs even though he will probably say no then go get the repairs done then take him to small claims court.

or B) get the repairs done then just have him served.... I'm thinking A

or C)wait for him to say no then take him to court then wait for him to do the repairs and what if he just says F it and does not do the repairs if the court orders it... what happens then?

Having been through emission testing here in BC many times I would say that a bad cat is rarely the cause of a fail.The most common problem here is waiting in line too long to get on the dyno.The cat gets cold and then a fail.I would do an eec self test first to see if any concerns.

"AS IS" IS NOT A LICENSE TO STEAL; MANY USED CAR'S COMPONENTS MUST WORK WHEN SOLD

Used Cars more than 10 years old or with high mileage are almost always sold "AS IS". Meaning you have NO implied/express warranty and YOU MUST pay for any repairs. BUT there are many car components that must be inspected/repaired prior to sale. And selling the vehicle "AS IS" does not relieve the dealer of insuring this equipment in proper working order:
EMMISSION CONTROLS: California requires ANYBODY (not just used car dealers) to only sell a used car which will pass the California Smog Check. Dealers must sell a used car with a valid Smog Certificate. In many instances dealers take shortcuts in getting a smog certificate issued and any used car buyer has a right to have the emmission controls repaired so a Smog Certificate can be properly issued. In many instances defective emmission controls adversely affect a vehicle's performance/drivability so repairs solve both problems.
SAFETY ITEMS: California requires dealers who sell a used car at retail to only sell vehicles that fully comply with all the requirements of the California Vehicle Code. This means that the brakes, steering, suspension, lights, windshield, tires, and other typical safety related items must work. A buyer has the right to make the dealer pay to repair any of these items that are not in compliance with California's Vehicle Code.
ODOMETER: The odometer must be working and an accurate odometer disclosure given to a buyer.

Definitely A. It will not hurt your case at all to have notified him that smog-related repairs need to be done and he is responsible for them.

or C)wait for him to say no then take him to court then wait for him to do the repairs and what if he just says F it and does not do the repairs if the court orders it... what happens then?

The next step is getting a property lien so he can't buy or sell any property in the county until the judgment is resolved.
