YETI, Can I make a respectful suggestion?
You're being sued. Regardless of how much in the right you may be, it is not prudent to make public statements about any aspect of the suit. Is the plaintiff's attorney monitoring this website? Odds are about 1,000,000 to 1 against, but I bet that if you told your attorney you were posting even the most general info about the accident on a message board, he or she would fall out of their chair. Feels nice to vent, but like it or not, you have to keep your guard up.

Lawyers can easily go on fishing expeditions in hopes of a large settlement to get a nice cut of. Insurance companies too often settle just to make it go away because of the risk of a large judgement.
I wonder if the loser was forced to pay all attorney and court costs for both parties iff that would cut down on alot of the crap that get's filed every day? But try your democatic congressman to push for that!

Great idea, and I even think this is the case in England. However, the Trial Attorneys Lobby is the strongest and most powerful in the nation. More than all of the unions put together. They would never stand for this. It would actually cut down on the amount of work these guys generate through the courts. Sorry to say, it will only get worse.

Just FYI, in KY a minor has 7 years after they turn 18 to file a lawsuit.

I know how you must feel. I lived under the cloud of bogus civil suit for two years before a witness admitted to a judge it was a scam for money because of MY work. We couldn't sell or buy a thing during that time, and it took a lot out of my family's life. The frustrating part is, although the suit was deemed a complete fraud, it was dealt with an "oh, well" attitude by the attorneys and the judge. I spent two thousand dollars of my own money, and these frauds got to walk away laughing. The fact that the guy is a fireman and friendly with the judge made it even worse. I'm still planning my revenge.
