engine failure

Cool engine failure

My 2006 pwr stroke started making an internal noise. After dealer finally tore down engine, brass filings were found in the oil filter and pickup screen. The upper rod brg shells show damage and the conn rod small end bushings show high polish with axial play although not "outrageous". The engine is clean with no signs of sludge. The turbo shows no wear, and the engine was running fine except for this noise. Ford's service engineer has denied warranty because I cannot demonstrate proof of oil changes. The pistons and cyl walls are in excellent shape. I cannot talk to anyone at Ford; the recourse I have is to file for arbitration w/BBB. Any help or comments?

The dealer is told that warranty is denied due to lack of maintenance. However, I still don't know what failed in the engine, where the brass came from, etc. We are a heavy truck dealer so of course the oil has been changed, we just don't have any RO's to prove it(the boss's truck). As I mentioned, the engine is clean and the turbocharger is in good shape.

Oooh. Are the last filters used in the truck OEM racor filters?There is no documents that have 6.0 filters around the office?

What has been your oil change frequency and your choice of oil and filters?

I have seen these guys recommended - but it is out of state for you (maybe they can direct you to someone equivalent in Ohio):

The only invoice we can find is one from NAPA. Changing around 5000m.
Lemon law isn't applicable for us.
Is there a thread/site spelling out various problems w/6.0l?

Yours is the first I've heard of that is chewing up and spitting out brass. Without filter invoices or documented oil changes you've got an up hill battle I am sorry to say.

I wish you luck on it. As Brickie said, it will be an uphill battle - especially if you took it in w/ a NAPA filter in it. Ford has a lot of bulletins out showing how aftermarket filters can ultimately cause damage (either from poor fit, filtration issues OR from actual failure of the element). They state their position clearly in the owners manual for legal reasons and due to the economic climate, they are getting very tough about any deviations from it. If you do have any success, please post it here - for others to benefit from if needed.

The courts have told OEMs that they cannot deny warranty based upon failure to use OEM parts.

That may be ture but unfortunately you'll have to sue Ford to get there and a different judge may decide against you.

Dieselman, I am a heavy truck dealer; I/my mfg can't force a customer to use our parts to deny warrantty unless, of course, the aftermarket part caused the failure.
