E4OD Shifted Hard

I just bought a 1995 F-350 Dually 460ci with a E4OD transmission. It has 158,000 miles on it. It started shifting hard like it had a shift kit in it. Took to a transmission guy and he ran the codes and it came back that high torque converter pressure and the torque converter overheating. The fluid is dark but the transmission does not slip. He reset the codes and it hasn't hard shifted on me but sometimes it will not shift into overdrive. I haven't taken any long rides on the highway to see if I can get it to get hot again so it will shift hard. The overdrive light on the shift lever doesn't blink. I heard that this happens when there is a problem. Another thing is the motor has a small miss. Could this be causing any of the shifting problem or is it all in the transmission? Another thing is when the key is just in the on position shouldn't the check engine light be on? I hope that I don't have other issues causing the shifting problems. Where should I start?

If it was me the first thing I would do is to drop the trans pan and replace the filter, then drain the torque converter and refill the whole thing with new fluid. To answer another question yes with ign "on" and engine off the check engine light should be showing. Possibly a defective bulb?
You can still pull any stored codes with nothing more than a paperclip, go to fordfuelinjection.com for instructions.
